Question Question about fiancee's murder case (45 days without indictment)

My fiancee was charged with 2nd degree murder in August and is being held in jail. No indictment has been made yet. His 45 days are almost up and the investigators on the case along with HIS OWN LAWYER went to see him the other day trying to force him into giving a statement. Theres no evidence against him besides someone else's testimony. No murder weapon. He is not guilty anyways, but I was wondering if his 45 days pass without indictment and he is released, how long after that do they have to submit an indictment, charge him and re-incarcerate him? The city we live in is very corrupt in general , not to mention the government or lack there of. The police department along with the court systems are corrupt beyond belief. So looking for some insight, suggestions, etc...

Thumbs up All I know!!

From what I know, If he is not indicted he could be let go. IF they find evidence..EVER against him, they can arrest him and charge him then. There is not a time line on murder.

Welcome to PTO, both of you! That is correct information, there is no time limit on a murder charge. If ever there is enough evidence found to indict someone it will happen. Good luck!

Yeah there isnt a time limit on Murders Michael Skakel is a perfect example of that he was charged 25 years later just pray and leave it in Gods hands...

I just read the post again and another persons testimony shouldnt be enough to charge him and even if it was I doubt it will be enough to convict him I also think that the reason why they are trying to get him to plea bargain is because they dont have any evidence on him and they just want to pin the blame on someone.. I wouldnt take a plea and I wouldnt give any type of statement at all I wouldnt even answer any questions they can take anything you say and twist it around to make it seem like something it wasnt
