help me im not sure if my son's sentence is determinate or undeterminate ?
My lawyer says my son got a "3 flat" yet on inmate lookup it says 2yrs 6mos,24days(min) to ( max) 3 years and he is eligible for merit release, he was turned down for shock, is he eligible for work release? if so, when?
he thinks if he earns 6 more supplement merit points he qualifies for work release. He is a first time non- violent felon. he said he gets 26 bonus points to start because its his first charge and he has to complete two or three programs. im soooooooooo confused.
He has been in since March 15th........Im going crazy!
I think you have to serve 6/7 of your sentence so that's what the 2 years and 6months is. I'm not completely sure hopefully someone more knowledgeable will come by and help you.
If it is a non violent crime, he is eligible for work release when he has enough points and when he has at least 2 years to his board (which would be the 2 years, 6 months...) So he should be eligible, if it is all non-violent crimes, after serving at least 6 months and getting all his points (through programs, good behavior, etc.).
If he has a violent crime, then it becomes 85% of his time that must be served. That's where the 2 years, 6 months comes from.
