Default low end of guideline or high end?

im going to be sentenced to 87-108 months....for the most part do they go low/high or depends on history, etc.

My boss (he does a lot of sentencing stuff) says that if there is a plea agreement, the gov't normally agrees that the "low end of the applicable guideline range is approptiate."

My husband was sentenced to the high end. He is a first time, non-violent offender. My husband's judge wanted to make an example out of him. We all went to court thinking that he would get the low end and his lawyer was shocked what the judge gave him. I believe it is all up to the judge. I pray that you get the low end. Hang in there.

Marc..............we know the most important issue in your life right now is high-end or low-end. No one here knows what you did. Most of us don't care. I for one know that whatever it was, 87 months is far too long. The low end is ridiculously inappropriate.

I thought without a doubt I'd be at the high end. I ended up as low as possible. You never know, its in the Judges hands. Only thing that will help sway his decision is the PSI.

I think a lot depends on the judge. My guy had the same exact range he was looking at, he got the high end. ( with a plea agreement) They had told him he would get the low end of it- and the attorney and the prosecutors even asked for the low end but the judge went high. Best of luck to you.

Without a plea agreement, according to my boss, the Judge must have a reason for the exacy point in the applicable guidelines range - if the sentence is more than 24 months. If shorter, no reason is required.
