Visiting rules reinstated

On June 16, 2003, the United States Supreme Court reversed the lower court’’s ruling in Bazzetta vs
McGinnis, which had found some of the Department’’s visiting restrictions unconstitutional. The high court
determined that because there is no constitutional right to contact visitation, the visitation rules adopted
by MDOC do not violate the U.S. Constitution. The 1996 Bazzetta vs McGinnis case centered on a
MDOC policy that was meant to end drug smuggling and to protect children visiting the facilities.
The Plaintiffs filed a motion for rehearing, but the motion was denied by the Supreme Court on August 25,
2003. That ruling allows the Department to return to the limitations in Department policy on who may visit
prisoners and how a prisoner’’s visits may be restricted for substance abuse misconducts.
As a result of the Supreme Court’’s ruling, the discipline policy for inmate substance abuse which sparked
the lawsuit has been reinstated and any inmates found guilty of two or more substance abuse major
misconducts will lose all visitation privileges for a minimum of two years.
Additionally, the following people will no longer be added to prisoners’’ approved visitors lists. If already
on a list, they will be removed by September 30, 2003 and no longer allowed to visit:
1. Former prisoners who are not immediate family members of the prisoner.
2. Minor nieces and nephews of the prisoner.
3. The minor child of a prisoner if the parental rights were terminated for reasons other than abuse or
neglect of the child. (A minor child already cannot visit his/her parent if the parental rights were
terminated for any other reason.)
This means that minors visiting a prisoner must be with an adult immediate family member or a legal
guardian on the prisoner’’s approved visiting list in order to visit. Minors will no longer be allowed to visit if
only with an adult designated in a power of attorney by the child’’s parent or legal guardian.
DOM 2003-14 has been issued to explain the changes. It also revises Policy Directive 05.03.140.F.Y.I.

This has been posted in a couple of threads now.....the rules just went back to the way they were a few years ago....the changes are relatively minor - although it was a big blow because several states were watching this also and plan on changing their laws accordingly.

Actually Michigan visitation rules are a lot more relaxed than a good many states.... We get more visits, prisoners get more visitors and we get a lot more time to spend with our loved one! Lets just hope these are the ONLY changes for a good long time!
