Hello everyone,
Does anyone know how would I go about trying to locate my husbands missing property? He was put up for a transfer like a month ago but was taken off the bus list last minute. He called me yesterday saying he was transferred to the prison he is currently. He thinks maybe his property was put on the bus by accident and now is possibly at the other facility. I would like to call the prison to try and find out anything. Who would I need to speak to regarding this? Any help would be appreciated. Thank you.
He needs to initiate a search for his lost property with his current prison. My advice is to find out from him the progress of his request, and only interfere if he asks you to. If his property is lost forever, there may be a procedure for him to be reimbursed for his loss, at least there is in federal prison, it's called a "tort claim".

R&R is responsible for property coming into the prison. I'm not sure they would tell you much, but he can talk to R&R at his current facility and ask about the procedure for lost items after a transfer.

It sounds like was bounced around a bit before he was finally transfered to his current institution. My advice is to have him inquire as to the location of his property.
It sounds like it was shipped to the wrong institution or it is still in transit. Sometimes it takes weeks for the stuff to catch up to him.
Someone at his current institution can track it down by emailing his old institution and also the institution he was scheduled to go. It might have gone there instead.
What can you do? Not much really. It's his fight to fight.

He needs to send 602 Inmate Appeal to the R&R sergeant explaining his property got lost.He needs to give as much detail as he can about the property. I think he should have received a inventory sheet when he turned his property in from the sending institution
Here is what Title 15 says 3193. Liability
(b)The department shall accept liability for the loss or destruction
of inmate personal property when it is established that such loss
or destruction results from employee action. Inmates shall utilize
the inmate appeal process if unable to resolve a personal property
claim pursuant to section 3084.1. Upon acceptance of liability, the
department shall provide to the inmate similar items of equal or
greater value when such items are available via donated property
items consistent with sections 3084.9 and 3191(c). If donated items
are not available, monetary compensation to the inmate for such
loss shall not exceed either the dollar value assigned to the item or
items at the time the inmate received authorization to possess the
property; the cost of the item, verified by receipt; or the replacement
value for the item or a similar item, as determined by the
department. Staff recommendations to the Victim Compensation
and Government Claims Board regarding monetary reimbursement
will be made accordingly.
