Default custody question-How do I obtain custody of my sister's children?

My sister went to prison 3weeks ago and she is 8months pregnant and she has a 8yrold daughter whom now lives with me. My sister will be in prison for 2.5yrs. How do I go about getting custody of her kids? I need custody inorder to put the 8yrold in school and I have to go get the newborn once she gives birth but she isn't willing to sign custidy over. What can I do? And the dads are not in the picture

have you considered just having power of attorney instead of custody?? it will give you all the rights to do what needs to be done without causing a rift between you and your sister... as trying as this experience will be, she will one day be home and i would hate for you to have the kids for so long and her to take them and you not get to see them... she will probably never turn over her rights voluntarily... so make a comprimise..

Well yeah that would work and she as already torn our relationship by stealing my identity so the only reason we communicate is for the kidds. But ill try the power of attorney that sounds good. Thanks

you need to ask for guardianship. This does not give you custody but you can get medical and schooling, daycare for the children while she's incarcerated. Upon her release and gets her life back on track then she or you can file a motion to terminate the guardianship. Your sister does not have a long enough sentence for her parental rights to terminated at this time.
