Default 85% of your Sentence: Can they keep him past the 85%?

This is my son's first time in prison and I pray that it is his only time in prison.

I need some help understanding this 85% law in Arizona. It states that an inmate only has to serve 85% of their sentence. I am understanding that this has nothing to do with "good time", my son has already lost all of his good time for early release. My question is, can they keep him past the 85%??

When he is released he will be on 3 years probation in Maricopa County.

The 85% is a privilege that can be reduced with disciplinary action. It has everything to do with good time. With enough disciplinary infractions an inmate can lose all of that time.

Hi,does that mean that when you say that they lose that time, they can end up serving 100% of their time if discipline action is taken.

Yes. They HAVE to serve minimum 85%. 85% is their “goodtime”. Depending on hiw many infractions & if they have more charges they CAN be made to serve all their time.

Everything everyone is saying is true but I have seen inmates with a lot of disciplinary infractions still get out at 85%. Im guessing because we are severely overcrowded. We rank 4th or 5th state with highest incarceration rate. We spend 1 billion dollars in taxes a year on prisons. Meanwhile, we are last in teacher pay. It’s high time we get another bill out there to repeal the truth-in-sentencing for all inmates and have it apply retroactively. We have to keep pushing.
