Default Awaiting sentencing , so many questions

Hi guys! 3 years ago I plead guilty to attempting to obtain prescriptions , I got 3 years diversion. I have nothing prior except a owi 12 years prior.

Fast forward and 2 years and 6 months into that diversion I caught a owi and a theft charge. I am on house arrest for that theft in a mother county and probation for the owi. I have done 6 months on house arrest and still counting .it has really helped. I'm in a treatment program, attending aa/na. My officer is willing to wrote a letter to court that I am in compliance and my treatment program is willing to do the same as well as state that I am growing working with them.

I did my psi. Last week they gave me the felony which I deserve , my sentencing is Feb 21. My lawyer has told me to not overly worry and if the worse case of jail comes I can get out after 90-180 days on shock probation.
My questions are is it even possible to be given a long probation sentence with this? It baffles me to cut a GPS bracelet off that someone is doing well with. My mind is going a million miles a hour and I just need to know what is a likely outcome , I know nobody has a magic ball. This is also in Louisville, Ky really look forward to your all replies

Your lawyer should explain all of the potential sentencing options that are available to the judge, and his prediction for what you should expect to happen. Catching a new felony while already on a diversion program from another crime is never a good thing. But your sentence will be decided by the judge who was assigned this case, so their sentencing proclivities will determine your outcome. I hope you are given another break.

I didn't catch a new felony. They gave me the felony and removed me from diversion so now I'm just waiting on PSI and sentencing. Appreciate your time

Hi Changes14, what was your sentence for attempting to obtain prescriptions? Usually the sentence is: X number of years probated for 3 years (diversion). It may be in your best interest to not file for Shock. I highly doubt you'll go to prison, but will serve your time in a full-service county facility. Have you had a revocation hearing and are being given your sentence for the original charge? What was the outcome of the OWI & theft charges? Were they felonies or misdemeanors?

Geez, it appears I have more questions than you do
I will say that Jefferson County is much more lenient than other, more rural counties in my experience.
