He needs to find out from his counselor, or from the Chaplain. Each warden controls weddings in their own prison. It should definitely be possible, but on their schedule.

Depending if you want the ceremony there, they do it twice a year or you can go to canon city and obtain the marriage license he just needs to sign an affidavit or i believe only one needs to be present, state of Colorado does not require anyone to marry them you can basically say your vows n marry each other

Talking Marriage in Federal facility: can we just sign the license? Or use proxy?

Hi,
My fiancee is at USP Leavenworth. We want to get married. Is there a way we could just sign the license? He is in the hole right now. Trying to get custody of his daughters. Their mother is crazy and unfortunately the girls are in foster care due to the mother's actions. If we get married it would allow me a good chance to get custody of the girls. We have been together for 4 years. Any input or advice would be helpful. Or would a proxy be a option in KS? What does it mean to declare ourselves married?

He will have to find the answers from the prison staff. Federal prisons, and the states where they are located set the rules for allowing prisoners to marry, so Leavenworth's warden, and the State of Kansas will decide.

Default USP victorville marriage

Does anyone know how to go about getting married at USP Victorville? Or do all the Federal Prisons run the same?

federal prisons operate under the same rules, but differently. He can find out what Victorville requires from his counselor, and/or the prison Chaplain.

We put in for it they said the Chaplin has to approve it but we sent the paperwork to the counselor still waiting to hear

Hi Ladydae How long ago was that?Do they only perform marriages in certain months of the year?

I'm not sure we put it in 2 months ago then they said last month I had to write a letter saying why? I did and sent it when I call and try to speak to counselor case mgr they say I'm not allowed they will get the info to inmate so he has to speak to them or the Chaplin ...I know it use to be June and December at Herlong this place we don't know they are hard to speak to

I'm more familiar with State than Federal...but I'm sure the process is at least somewhat similar. He needs to speak with his Caseworker to get the ball rolling. I'm not sure if Federal has a Marriage Packet or list of guidelines of some sort, but usually its up to the one in prison to get things started (as I understand it). You may both be required to Write the Warden and ask permission..then wait for that permission (or denial as the case may be). Some facilities only do marriages on certain days (they pick). You will be the one responsible for finding someone to perform the ceremony. Marriage license are normally only good for so many days (approx. 30), so don't get it until you have all the other ducks in a row and a definite date.

Great answer for you here. Your boyfriend obtains the packet first. He just needs to ask his counselor. If he gets nowhere there then speak with his case manager or the chaplain. Then a packet is sent out to you with instructions. That day I could bring in flowers (I made him a boutineer and me a small bouquet) and our wedding rings. We had to use the "chaplain" they picked which was some really really old lady (our religion does not allow women as clergy so it was odd for us). I paid her the required fee, she called me a few times before the date and I showed up on a non visit day. We got to go in a lawyer room with her, hold hands throughout the ceremony and kiss a really long one. C.o.s were in the outer visiting room and the chaplain lady said take your time! Afterwards he got to visit with me in general visiting room about 30 minutes and that was that. I lucked out it was 3 days regular visiting after that and one holiday so our honey moon was getting to visit him the next four days in a row. I just wore a burgundy dress, flats and had just come from a job interview. LOL... But it was our wedding and he made it special by saying wonderful sweet things to me and I will always remember it. Prayerfully I will get to be his wife on the outside as his out date is still really far off. But with laws changing we can hope he is out sooner. I hope this helps. Enjoy your day.

It is VERY facility specific. Your best bet is to browse the forum for his facility and then ask him to contact his counselor for the packet. After that, the only thing we can tell you is how it was for us. In Cali, each facility handles weddings differently and even that changes based on who is the marriage coordinator at the time.

Step 1. He needs to request the packet from his counselor.

Step 2. Follow the instructions.

***Sorry, just occurred to me this is a fed facility. I would still start with Step 1.

I married my husband in federal so the rules are the same one to the next facility. But first off it is the mans responsibility to do the ground work there. The rules are the same probably the rules in Victorville will be carried out to the extreme though. We werent married in Victorville but I am very familiar with it there.

You might want to read around our HAWAII FORUMS for more information and see if anyone has faced your situation. While proxy marriages are legitimate in some states, not every state accepts them so be careful about checking the facts.

Here is a link to the policy on marriage in federal prisons. I hope it's helpful. Remember that BOP rules are going to be independent of any state-specific rules you find in a state-specific forum.

The best resource you have for getting things started is going to be your fiancé.

You may also find some information here http://www.prisontalk.com/forums/forumdisplay.php?f=716, as marriage in prison generally requires that the regular rules of visiting also be followed.

I think you're going to have to be there in person for the ceremony, but you can do a lot of the paperwork by mail. You might want to consider speaking with the coordinator at the prison who can spell it all out for you without any question as to the validity of the information. I have only heard of proxy marriages being recognized in very specific and limited circumstances and not in federal prison.

Can anybody tell me what is a Certificate of premarital examination? Where do I get it? I'll be marrying in Milan FCI next month. At least we're trying for next month, finding an officiant is a mess.
