I think that is something the jail/prison would decide. You would know when you talk to the *counselor*

Since you said you will be testifying against your former boss, the "deal, aka your punishment" should be negotiated between your lawyer and the prosecutor, including "work release". Then it will be decided by your sentencing judge, but plea bargains are usually adopted, as written, by the courts.

There is information available on line too. Google "maryland prison work release" if that's the court system where the cases will be tried.
