Default Lawyer not returning calls

My loved one has been in Cook County since Jan. Early on I hired a lawyer who specializes in his type case. He got the process started and came to the first two hearings; then the Covid mess hit. To make a long story short, I've been trying to contact him via phone/text for the last two weeks. He doesnt return any calls. I understand the whole system is a mess etc esp at Cook County with the Covid situation, but I believe this lawyer could at least give me a quick update; I did give him a nice retainer fee at the outset. So my question is, are all lawyers swamped right now with cases? I'm trying to give this guy the benefit of the doubt, and understandably I dont want to start the whole process over with a new lawyer as my LO sits in there.

Honestly, your LO is the client, not you so the attorney really doesn't owe you any updates. If your LO can't call him, then have your LO write him a letter asking for an update.

You hired this lawyer to represent your loved one not you. The lawyer is not under any obligation to call you or discuss this matter with you. Next time you speak to your loved one. Ask him to ask the lawyer to keep you informed on the matter. Then maybe the lawyer might return your calls (doubtful) Just becasue you paid the attorney doesn't mean that you will be kept in the loop.The ball is in your loved ones court if he wants his lawyer to discuss his matter with you

I'm having the same trouble. I don't think attys are taking any new clients and not returning calls or answering. I know you're not new, so that doesn't really apply to you. I know in my man's state, a state of emergency has been declared. The courts have shut down, and atty offices are shut. I also know the state has extended deadlines due to this reason. They issued a declaration on the matter. That is possibly the case with you. I would look into the state's situation of wherever the atty is and see when their emergency or quarantine is scheduled to release. You can also try calling other attys and seeing what they say as far as your atty's reputation goes and the state's situation with the legal matter. Good luck! We all need it now lol

Thanks for the replies. For the record my L.O. has also called him and wrote. And between the two of us we havent incessantly indundated him with calls. Had I known this was going to be the case where he doesnt have to update either of us, just out of common courtesy, I definitely would not have hired him. I've had better results with other lawyers who have communicated well, but I couldnt have them for this case since they didnt do criminal cases. And I personally feel I shouldnt have to go out and hire a new lawyer.

My husband and I were in a similar situation as you. We hired an attorney gave him his nice retainer and that was the last we saw of him. no call back, no keeping us in the loop, no talking to our witnesses nothing and when he did call it was to bully my husband into taking a plea. I hope that your attorney has a conscious because ours sure didn't.

Thanks---the thing is the lawyer shows up with no violations; I checked the bar assoc. etc and he comes up good. I know a person cant really believe the reviews but all of them are 5 stars. I'm blaming a lot of it on the covid situation and the fact my LO is in the war zone known as Cook County jail. Guess it's all about keeping the fingers crossed and praying!

I suggest that you review the arrest report(obtain it from the D.A office) fill out the request(Discover request) then the District Attorneys office will get it to you. Review this report with a unbias mind . Then decide if you still want to poor more money into an attorney. Sometimes you must really decide if a private attorney will really make that big of a difference on the out come. of the matter. Is the $50,000 worth it now or will it come in better at a latter time ?

Most courts are closed to everything except for emergency issues. You can check with the individual court to see what is going on, but barring a major emergency, nothing is going to happen.

LE is swamped with COVID issues in addition to emergency issues. The State's Attorney and most law offices are running from home. Most pleas are handled via video hearing, but it sounds like you are beyond that already. Best to not expect much until there is a slackening of the restrictions. Many law offices are closed for the duration of the crisis.

This "corona" mess is hitting everywhere so the attorney could also have become ill. Thus happen to one of my man people. Test positive. :

While little comfort to someone with a LO in jail, sometimes from a defense attorney's perspective, no news is good news. As others have stated, most courts are shut down so it is likely nothing is happening in your loved one's case right now. With nothing going on, there is nothing to report. Hang in there; I would imagine as soon as the attorney has something new to report, he will be in touch, and hopefully before any upcoming hearings.

In times like these, I would say if a decision needs to be made between bail money and a private attorney, it may be worth the while to post bail and go with an appointed attorney.

Illinois license - hearings are being pushed back. Info can be found here

Can go to the Illinois Supreme Court for their guidance, but Cook County is shut down through May. Barring emergency issues, nothing is happening. Arraignments are being handled via video. As things open up in the summer (at the earliest) expect things to happen slowly. It is going to be a while before they even consider holding a trial.

Offices are closed. Courts are closed. Nothing is happening. We get emails with orders both in IL and IA circuits about this stuff. Since communication is negligible, nothing is being done.

Note, people who are in Pretrial detention or within something like 60 days of release for their Misdemeanor or Class 3 nonviolent felony sentence who are in the Cook County jail are having their cases reviewed for possible emergency relief to Freedom. This is all done with a file review with no court date or hearing
