Default How much good time off can I get if I get 9 months prison & 9 months home c

How much good time off can i get if I get 9 months prison & 9 months home confinement?
It looks like I won't be able to get RDAP because my sentence is too low.
How much time will I get off for good behavior?

You will need to serve 7 months and 3 weeks about, it's supposed to be you serve 85% of your sentence BUT because of the way the BOP calculates it, you end up serving 87% of your sentence. The last 3-weeks they could release you to a half-way house and the halfway house could release you immediately (well after an interview where you would have to meet a bunch of criteria) to home detention and maybe would.

Sorry, but you'll get NO time off for good behavior. You'll be in prison for the full nine months. Good time off only applies to sentences of 366 days or longer.

Only thing is if you get 18 months no split...you will do about 11 1/2 months on the inside with last 3-4 in a halfway house.

On a 9 month sentence, you may get 1 or 2 months of hwh, depending on the institution. So many variables at play here. Depending on what you get you'll want to make sure its clear in the sentencing document or you may be in for an unpleasant surprise when the BOP takes what the judge ordered as a "recommendation".

Best wishes..

Ask your lawyer. Since your total sentence will be longer than one year/one day in length, the answer may depend on how the judge describes it in your judgment & commitment sentencing order. If the bop thinks your sentence is 18 months, you will earn 70 days of good time. If they consider it to be only 9 months, you will earn zero good time, as already explained.

I'm not sure if it matters, but it is certainly worth finding out.
