Default New to forum Attorney willing to help

Hi,

I just joined because my fiancé has been sentenced to a year and a day for wire fraud. He will be going to FCI Morgantown. I plan to use this forum for advice and support during his sentence. I am a licensed attorney. I thought I’d pay it forward by answering questions. Keep in mind, however, that I am not your attorney and my suggestions are general information only. I have a question, My son is incarcerated in NJ, which I found out that it's one of the worst state to commit a crime. When it happen he was 18yrs old and at his sentencing it was crazy... the gave him 23yrs and it has been his 1st ever time in contact with the law. I was hoping that I could get some information for sentence reduction or even having his charges run concurrent. It will be 3yrs in may. Please let me know if you or could give me any information.

My guess is that 3 years into a 23 year sentence is too early for relief, but you can definitely know your options, and work on getting his sentence reduced.

If a inmate has been on deathrow for 9yrs & his case is in a appeals is it too late to look for lawyers that will take his case

If his case is in appeals he already has an attorney appointed for him.Hiring a private attorney to handle the kind of appeal you are speaking of a cost several thousand dollars just for them to review it
If you are trying to seek a new trial that is a whole different thing. Death penalty cases in California are very complexed and in depth There is the trial for the offense Then there is a sentencing phase which is also like a trial.

There are a dearth of DP attorneys in CA willing to take appeals, so it is quite possible that the poster's friend does not have an appeals lawyer at this time. From what I understand about CA DP law, this is okay. Nothing will happen until he is actually represented and in CA, 9 years on death row is nothing. Inmates are far more likely to die of other causes than execution at this point. CA continues to wrestle with repealing the DP, the last time it came before the legislature was in what? 2016 or 2017.

Another issue that has pretty much put a stop to actual execution in CA is that they are having a hard time finding doctors to actually oversee the procedure.

But, that is beyond the scope of the question. At this point, if he has been appointed counsel, he has to wait. Eventually, counsel will be made available to him.
