Default Board approved release w/monitor, PO saying Halfway House, Can he do that?

My son is on parole and was released last week from county jail with an ankle monitor. He went to see his PO this morning and was told that he will have to go to a halfway house in about 3-4 months and "restart" his drug program even though he was never in a halfway house before. He is supposed to find a job for these 3-4 months, then he will have to quit the job to go to the halfway house. This makes no sense to either of us. The parole board approved his release with the ankle monitor so how can his PO override this decision? Is this something we could dispute? Should we send a complaint to the parole board?

You could see a post-conviction lawyer. They can help you sort out if there is any legal remedy for the decision. I would be hesitate to advocate directly to the Parole Board, it could reverberate on you.

Be aware that parole officers have massive powers, and the ability to return anyone to prison. I agree that anything you do without a lawyer is more likely to result in trouble for your Son than anything positive.

That’s extremely bizarre unless he’s somehow violated parole within the last week.

In the years of dealing with Texas POs, I’ve never had one tell my husband where he had to live, except that he had to live in the same county as the office and stay in the state. His requirements were set from release - x number of NA meetings, x amount of monthly fees, get a job....I don’t believe we’ve had one requirement added the entire time.

Either I’m missing some backstory or the whole thing is kinda odd.

Or you could meet with the PO and find out what the Court/Parole Board/PO expectations of your son are and you all can work together. Most officers are willing to work with family as long as they aren't enabling.

Yes short term it looks silly. Him getting a temp job is probably to keep him busy until he can get into treatment.
