Default Home monitoring violated: Home monitoring again if work verifies schedule?

Iíve been looking through all the threads and canít find anything! My husband was on home monitoring and the sheriffs came and arrested him yesterday for violating his home monitoring we are in Chicago (Cook county) they said he wasnít going to work like he was suppose to! Can he get home monitoring again when he goes to court if his job sends his schedule & days he was actually at work? Also, they arrested him about 8pm yesterday & he hadnít called or anything is that normal? Iím freaking out!

It will be up to his judge, but if he wasn't due at work when the Sheriff decided he was supposed to be working, that sounds like extremely pertinent evidence for your husband to present at his hearing. Even so, a lawyer could help insure that he isn't railroaded.

They cancelled his movement for work and said he had to wait for the sheriff to come before he could leave for work, when the sheriff got here they asked for his check stubs which he didn’t have but he had a letter on company letterhead stating that in fact has been at work they wouldnt accept that and said they checked his movement and it showed he was places he wasn’t suppose to be while he was supposed to be at work! I don’t know what’s going on it’s now after 6pm and he still haven’t called. I’m worried sick..

He has some kind of GPS monitoring device that indicated he was someplace other than work during working hours? And when the sheriff showed up he was unable to produce a pay stub but just so happened to have a letter handy saying he had been at work?

I hope he’s got more evidence than that... presumably the job has to submit a schedule in advance? I know here the inmates can’t submit their own schedule, it has to be directly from a specific person at the company. Did they change his work schedule after submitting it for him? If that’s the case they might find it forgivable.

The community release program here, whether it be home monitoring or work release, is a one-chance deal. You mess it up, you sit on your butt back at the prison. They have zero interest in any shenanigans.
