I am not a Mississippi attorney, so your best bet would be to consult a Mississippi attorney.

Generally, drug court is used in lieu of regular court. What happens is a person pleads guilty to a crime in exchange for going to drug court, doing whatever the drug court judge and PO and counselor require. The guilty plea is held, and if the person successfully completes drug court, that guilty plea goes away. The charges go away.

If he violates the conditions of drug court, he appears before the judge, and the judge can make that plea real, finding the person guilty. Then the prison sentence happens.

It sounds like your LO is already in prison, having violated his probation strongly enough that he found his way into his full bid. You are wondering if when he gets out on parole, he can be assigned to drug court. I am unaware of a state that uses drug court for people who have already been sentenced as felons and done their time.

Imho, when he gets out, he needs to commit to his sobriety and tell his PO straight out that he needs close supervision to make it. He needs to actively work on a plan for what it will take to make sure he stays sober and not using. The more open he is with his PO and his needs, the better.
