Default Which states dont have a 3 strike rule

The following states have 3-strikes laws:

New York
Texas
Washington
California,
Colorado,
Connecticut,
Indiana,
Kansas,
Maryland,
New Mexico,
North Carolina,
Virginia,
Louisiana,
Wisconsin,
Tennessee,
Georgia
Arkansas,
Florida,
Montana,
Nevada,
New Jersey,
North Dakota,
Pennsylvania,
South Carolina,
Utah,
Vermont
Arizona
Massachusetts
Missouri


looks like alaska, hawaii, alabama, Mississippi, minnesota, oregon, idaho. wyoming, oklahoma, nebraska, south dakota, illinois, maine, west virginia, ohio michigian,iowa, kentucky, delaware, rhode island, new hampshire do not have 3 strike laws..

what about D.C? i know thats not a state.

Idaho doesn't have a strict "three strike" law per se, but they can (at prosecution's discretion) hit you with Persistent Violator (Habitual Offender) for your third felony conviction, which can enhance any felony sentence up to Life.

Often times though, this is used as leverage to get the defendant to plea bargain down to whatever other serious charges are being filed, usually only if the defendant dares challenge it and take it to trial do they not drop it.

Texas does not have a true 'three strike' rule. We allow a Grand Jury to add enhancement paragraphs for ANY prior final felony conviction. If one has two prior felony convictions that are final, they are subject to being enhanced as a habitual felon although few are actually sentenced under the 25-99 or life habitual provisions since the paragraphs can be abandoned in the plea process.

This is, unfortunately, the reason we see eight-time DWI offenders serving sentences still in the single digits...
