Mine lost his appeal, but after that he has his post conviction (Which is what he is doing now). From what I know at the post conviction part his lawyer can bring up a lot more issues then is allowed during the appeal part. But I have heard of appeals going good so just keep positive. Good Luck
My bf's direct appeal is still pending. We're waiting on the state's response to his attorney's proof brief and designation of parts. She found many, many things wrong with his trial but only had room for 7 in the proof brief. She was limited to 50 pages. It has been nearly three years since his trial attorney filed his appeal, and we are still on step 1.5 of the process. Patience is a very necessary virtue in the appeals process.

Most appeal attorney's play the over worked and under paid scenario. The fact his appeal attorney has took to time to find anything is great. I did months of reseach and found over 15 things wrong with my fiance's appeal case however since his car accident injured and off duty officer he has been set up by the state to fail no matter what.
It looks good for you for now just make sure to keep contact with his appeal attorney and get updates. Sounds like you have an attorney who is not the average slacker! Things look great for you from my stand point.
also every state system has all charge codes, appeal lawyer info you can get everything you need from transcripts to please reports to toxicology reports and all information need to suppot his case from the county websites. I hope this helps but beleive me everything you woudl need to look into is right there just google search the speciifics. In fact you can even reseach his appeal attorneys record via the county site to see how many cases he/she won and the outcome. if you need help call your county sherifs or police office they can direct you!
