Default Info and advice please????

K 6 months ago my man got out on parole after serving 9 years had ankle monitor and all then one day he decides he's going to cut the monitor off now he's back in CJC on a parole hold and might be facing an excape charge??? How much time will he get can he fight it???

unfortunately I know about this one a little bit. of course every case , person, county, judge, criminal history is different.

I think he will be charged with escape....which in my friend's case is an additional 3 years DOC. I don't think you can fight it. He cut the ISP monitor off. Which can make it even worse. Did he turn himself in?
there is a colorado statute for escape which the court goes off of, i don't remember the number. but you can look it up. It defines what "escape" means exactly. But it is definitely a new charge. And cutting off the monitor, falls into one of the many ways an inmate "escapes". I'm very sorry you are going through this. They don't realize what idiots they are being and how it effects loved ones. If I remember right, he can not get a sentence longer than what he was on parole for in the first place. Unless he is a habitual offender.

No he didn't turn himself in...one day last month he went to go hang out with a friend n the snitch turned him in....yes he cut off his monitor but dropped it off at the parole office...lol...the whole reason he decided to cut it off was cause he was driving after the fact of having 2 DURS and he hit a parked car fled the car he was driving and not even maybe 5 blocks away from that he cut it off n took it to the parole office....

so how many felonies does he have? If this is his 3rd felony it is the big b i think.
cutting off the isp monitor , fleeing the scene of an accident , driving while on parole , 2 duis all = more prison time I think.

I know it's all hard to hear. I know first hand. but maybe at the very least you can prepare yourself for the worst. how many years was the sentence that he was on parole?

no, what I meant was, how long was his prison sentence last time?

because IF I am correct, his escape sentence cannot exceed that amount unless it is aggravated.

oooh weee. I cannot for the life of me think of taking that risk and facing that consequence. My inmate caught his first charge in his 40's and is serving a nice bit, if the fool goes back for doing 3 things wrong at one time----I could easily say deuces..and I have known my inmate 20 years! I am so sorry he drug you into this lifestyle. He doesn't seem to mind it, I can't think of any other reason to do alllll of that at once.

ok well i wish i knew exactly what will happen to your boyfriend. After this escape charge happening to my friend, I have heard of offenders getting anywhere from 6 months to 8 years sentences. so hopefully your boyfriend will get a small sentence. hey he's not in arapahoe county! that's a plus!
