Unhappy Innocent pleading guilty :(

My 16yr old son has found himself in a very bad situation! he was hangin out with 3 friends, when one assaulted a man knocking him unconscious and breaking his jaw. my son is also facing charges because he was with him, and the DA is claiming group assault! My son is completely innocent, but is looking at a +3yrs and a strike, if found guilty on all charges. they offered him a lesser assault charge pc245(a)(1), but still has to plead guilty to it! im sooo worried hes going to get "time" for pleading guilty to that charge, even tho hes innocent!

Hi and welcome to PTO. I am so sorry you are going thru this but happy that you have found us. You have come to a great place for support and info. We have a forum here for parents that I think you might find very helpful while you are dealing with this. Here is a link to that forum Parents With Children In Prison. The woman in this forum are really supportive of each other and are there to help each other get thru all this.

I sure hope that things work out for your son. It is a shame that he has to go thru this because of someone elses actions. I hope that he can avoid having to do time. Please check out the forum I gave you the link to above. I really think that you will get lots of support there.

Sorry to hear that,
i kinda understand my bf
was with 2 of his friends
when he got locked up
for what one of them and they
all got a the same charges
even if he didnt do it):

hello and welcome! sorry to hear about your son. my daughter was in a situation similar to yours. my daughter was invited by her so called friend, this girl confronted her ex bf make long story short...out of the whole group, the girl, the ex-bf, his brother and my daughter. my daughter was the only one who got blamed for everything and was looking at 6 charges two being pc245(a)(1) 4yrs and 2 strikes. DA was willing to drop 4 charges and were still trying to make her admit to the 2 felonies and 2 strikes. i consulted an attorney who said would b piece of cake but was chargn 8K to represent. the PD wasnt really much help. i told my 16yo daughter to take it to trial which she first started but the PD had no luck finding the two guys (victims)(later i found out the ex-bf of the girl had been arrested the day after my daugter decided to take it to trial, on violating parole and having a dagger pc12020(a)(4)). anyway DA still not wanting to let her go added another charge, charge #7 pc 12020(a)(4) 3yrs felony. her PD told her to take the plea bcuz if she was found guilty she would have to do more time...ugghh....personally i think they were just trying to scare her which they succeeded and she took the plea...she had been in juvi since jan 8 to march 8 of this yr and was in UC (max security) was escorted anywhere she went. she returned home on march 8, will on home sup for 1 month and 1 yr probation wit lots of rules. ohh and by the way her counts were dismissed on a harley waiver which means the judge can bring any or all the counts back if she violates probation, so she would b looking at yrs in custody. to add this my daughter is type 1 diabetic or juv diabetic which she is insulin dependent. hah of course there's more to the story. my best bet is to try and get a private attorney to represent him if you have the funds. good luck!

Default my son

My son was in the same position at 16. He plead guilty and was told if he checked in with his probation officer and followed all rules for one year they would reduce it to a misdemeanor. He went back to court after the year was up, and they reduced from the felony to a misdemeanor. I was so thankful for that. It is not the end of her life even if she has a little time to do. She is only 16. Reminder that she has her whole life ahead of her to look forward to. This is only a bump in the road!!
