Exclamation How to not get classified as a youthful offende?

Ok so my husband is 19, he was sentenced as an adult this time around. When he got sentenced he was told by the state that he was not going to be sent to a youthful offender camp that is the only reason why he took 6 yrs with no probation. He is currently in CFRC and I got a letter and he stated that they are saying he is going to end up at Brevard. Now I know someone knows about how he can get out of it? Pm me or reply. SOMEONE HAS TO KNOW SOMETHING. HE JUST CAN'T GO THERE, too complicated to understand but he has to be sent to an adult camp. Thanks for all the help.

Although the courts may not sentence a person as a YO, DOC can classify them as YO. I know that not having a GED is part of the criteria for that, but not sure about anything else that comes into play.

Question Youthful Offender Prisons

My son may get a Youthful offender status. I looked on the DOC website and clicked on every prison in Region I, i did not see any that was listed as a YO prison.

Does anyone know where they might assign a Youthful Offender?

There are two in region 2 and one in region 3.

Lancaster and Lake City are in region 2.

Brevard aka gladiator camp is in region 3.

Pray to God he does not go to Brevard. I will pray for ya son.

well YO status helps with the sentencing...if he is looking at serious time.... a YO sentence would go no higher than 6 years...

keep in mind that he could be sentenced without a YO status and still go to a YO prison.

for example:
18 year old robs a house with a gun.
let's say by age 19 he is sentenced to the mandatory minimum(firearm) 10 years in state prison.

The judge couldn't have used the YO status because u cant pass 6 years of either probation or imprisonment if u do.

He'd be sentenced as an adult in my example.

At the reception center, they can decide to send him to an adult prison or they can send him to a YO prison. How? Well, he is still in the YO age range in my example and when a judge sentences someone as a YO, it's only a recommendation... it affects the SENTENCING, but the DOC ultimately decides where u go.

Various factors determine where u go.

Oddly enough, u can be sentenced as a YO and still go to adult prison.

However, most of the time if u get sentenced as a YO, you will go to a YO prison.

Oh and ur tryna keep him in region 1? Well, that is a long shot to be honest.

How old is he? I think Santa Rosa CI is the only region 1 prison that has an under 21 dorm which is where he'll be if he is under 21. I could be mistaken and there could be others though.

I would need more info to help u out on where he'd go.

He is in the NWF Reception Center Annex currently. He is 20 years old right now. He got sentenced to 3 years for vop and a concurrent sentence for a marijuana charge, he has done 9 mos in county.

I've heard bad things about Santa Rosa

Thank you so much for your help

Then he should know what his status is then since he was already sentenced.

When does he turn 21?

Do you have his scoresheet? There should be a check for YO, if not then he was sentenced as an adult.

If he turns 21 within the next month or so(how long has he been in reception? has he already been classified?) then he may get to go to an adult prison.

If he turns 21 months from now then he can still go to a YO prison or an adult prison and be housed in the under 21 dorm until he turns 21.

and ima moron lol I forgot in region 1 there is Jackson CI which has that dorm and Apalachee East Unit(pray he doesn't go there).

I don't think the others in that region have it...

it's not a guarantee that he stays in that region... but most likely he will either be sent to a region 2 prison or stay in region 1. No way they send him down here to region 3 or 4. Region 2 has the most prisons.

alright I checked the population list for some of the region 1 prisons to see which ones have under 21 inmates and there are 50 in one... 8 in another.... 78 in another

so yeah I guess there are more than I thought. DOC does what they want.

He just turned 20 in January. I was told you can get YO status up to age 24. His current status says minimum on the doc website. He told me in a letter he may get YO so I assume he has reason to believe this. He hasn't been classified yet. We haven't been able to get calls yet and he has been there a few days shy of a month. So all we've gotten is half a dozen letters.

His attorney told us his score before but for the life of me I cannot remember it.

Thanks again for the help.

Well if he gets YO status then he will go to either Lancaster, Lake City or Brevard.

No problem!

-edit- and to be sentenced as a YO, the sentencing date has to be before you turn 21.

Quote:
Pursuant to section 958.04, F.S., the court may sentence as a YO any person:

(a) Who is at least 18 years of age or who has been transferred for prosecution to the criminal division of the circuit court pursuant to chapter 985;

(b) Who is found guilty of or who has tendered, and the court has accepted, a plea of nolo contendere or guilty to a crime that is, under the laws of this state, a felony if the offender is younger than 21 years of age at the time sentence is imposed; and

(c) Who has not previously been classified as a youthful offender under the provisions of chapter 985; however, a person who has been found guilty of a capital or life felony may not be sentenced as a YO under the Youthful Offender Act.
http://floridasentencing.blogspot.co...-youthful.html

Check the scoresheet. The judge already sentenced him as a YO or adult.

I think that whether or not he has a HS diploma or his GED will also play into where he goes.

And Indian River is also a jit camp in Region IV.

Yeah I forgot to mention that. if he has no GED or diploma then it's prolly a 90% chance he'd go to a jit camp.

and Indian River houses inmates from 14-18.
