Federal Judge Says CA Death Penalty Unconstitutional
 
A federal judge in California called the state’s death penalty system “unconstitutional” in an order issued Wednesday, excoriating the system as “arbitrary” and “completely dysfunctional.”

unfortunately, it only applies to one case and will be appealed. Still, this should be heard at a higher level, and it should be determined if these huge waits are constitutional, especially in places like CA, where there's a greater chance you'll die of natural causes or suicide than on the gurney.

Hope this leads to an evisceration nationally of the DP.

Well considering that Jerry Brown ( Ca Governor) and Kamala Harris ( Ca A. G) is openly against the death penalty plus voted for the prop 34 in 2012 We'll see about it being appealed. Regardless if it applies to the one case many will rely on it for relief especially the 17 in ca that can legally executed at the stroke of a pen. The Death Penalty in california is dead. I hope that it is heard at a higher level. I'll attach the opinion shortly.
