Probation Discharge Papers
I was placed on probation for possesion of marijuana a year ago. My probation ends August 12, and when i visited my PO on july 24th, he said this is our last meeting and shook my hand and said, "your off probation, if the judge declines your discharge papers which he really has no reason too then you'll hear from me"
He made it very assuring that there will be no problems and said "there is no reason for him too". With my year of probation i failed about 4-7 urine tests roughly, and had to do IOP and then rehab. I failed the IOP at the end and had to do rehab, which i completed successful and did great with. Ever since rehab i've been clean and doing well. All throughout probation i payed my fines EVERY visit and maintained a job and had good school grades... So i have a few failed urines, but no new charges or anything, payed fines accordingly, never missed a meeting with PO and followed there orders when failed a urine test... *do you think my probation will get extended or anything? my PO said the judge has no reason too and i didn't even ask him anything about the judge extending it..* any thoughts? it's been a week and no notice or papers or anything. Any thoughts or suggestions or comments would be great, thanks :thumbsup: |
If your PO is recommending that you be released from probation, your chances of having that happen are far better than if the PO filed a PV with the judge. Since the PO said the judge has no reason to decline the paperwork, I wouldn't worry too much about it. I hope you receive your discharge letter soon.

Yes a parole violation. It depends on the wording used there, but a PV is usually in the form of a motion from the PO to the court to consider punishment for going against your parole restrictions. Apparently your PO had the discretion to handle your dirty urine tests without filing PVs with the court.

Only that you try to be patient. If the PO has submitted the release paperwork already, the process will be completed on their time, whenever that happens to be.

Coming up on two weeks, don't mean to rehash this... Because the answer to my question is simple; PATIENCE. But i'm curios if i could call my PO and ask when i could see the discharge papers in the mail or if the judge seen it yet, or anything... Or is it best to hold off?

Do you think the judge is going to wait until the exact date that my probation ends, or is the paperwork just slow with the system.. I've heard people getting this discharge papers within a week.

Could i call my lawyer and ask him if he received anything about it..

My son just got off probation and it took about a month for everything to be done. He was on interstate compact to another state, which probably delayed things, but it did take about a month all told.

Appreciate the response. I just hit 15 days, so i'm hoping it should be in the mail anyday now. The anticipation is killing me. I'm holding off from calling my PO , for another week. Thank you for response, greatly appreciate it. I saw someone on this forum got their papers in a week, i guess i'm not the lucky one... haha

my date i was supposed to end is the 12.... Are they going to hold the letter untill then?

2 days past my probation end period. Still nada letter. Still made it though!...

Am i technically off probation? By law? I keep telling my self i'm off i made it, but then i feel like im lieing to my self. This probation has been a ride, and i want this paper saying i completed it. It will be a amazing feeling of accomplishment.

Being told by alot of people that i'm not completed until i get these papers, regardless if it's my discharge date 3 days ago. Is that accurate?

Since you haven't been notified that you are actually off, it makes good sense not to do anything that might constitute a violation if, in fact, you haven't been released yet. Why take a chance of messing up at the last minute, even if it is only a very remote chance?

I hate to be the bearer of bad news, but it took a while for me to get my discharge papers from the PO...I don't remember exactly, but it seems like it was at least a couple of weeks. :faints: They were not mailed the day after my official release date, although the actual date of discharge was correct on the paperwork. Now....Breathe!! :)
