Hi All,
My man's hearing was scheduled for July 04, and becuase of the back log got re-scheduled to Jan 13th. now I am being told due to clemency hearings. they re-scheduled it again for May 2005????????
has anyone had this same problem or heard of any such thing?

My husband's friend also had his parole hearing postponed. What's going on?? He was supposed to have it in August of 2004, and it was postponed to February 2005. Now there is talks it could be postponed again. How frustrating.
However, on an up note, my husband said that most of his lifer buddies are getting dates. Even lifers with serious offenses are getting dates. Maybe patience will pay off in the end. Good Luck.

Wow agrlsparky, I hope that's true!
I wonder if it has to do with the case in the state supreme court? There is currently a case challenging the Board of Prison Terms. More or less, it says the rules state lifers should be given an out date for their minimum sentence unless there is strong evidence to the contrary that they are a threat to public safety, and that the rules should be upheld, not ignored as they always have been. (Crossing fingers)

My husband told me that his buddy was sentenced to 7 years to Life. He had served 11 years at the time of his parole hearing. When the parole board had seen that he had served 4 more years than his minimum sentence, they automatically paroled him. His buddy said, "Once they had realized I had served 11 years, they granted me parole and didn't even ask me any questions." It seemed as though the parole board had screwed up because his parole dates had been cancelled and postponed repeatedly. By the time they got to him, he had served too much time---according to them. Interesting bit of information, Huh??

They have to pass their matrix.Thats why its being a concern and these lifers are kept in illegally.bpt is not following the Laws.
here are some advice for the newbies, and make sure they have job training classes, Ged, and anger management, religion, AA classes. At some cases you may not need it but it helps. support letters from any body you can think of, job reccomendations,
They just want to make sure if they parole that they are busy.

I am kind of wondering what is going on with these hearings. I don't know if my husband was given wrong information (but he very well could have been, we had a BAD lawyer!!!) My husband was sentenced to Life plus 16 years for an attempted murder. At a Post Conviction Relief Hearing his sentence was reduced, well not his sentence but his enhancement was reduced from 16 years to 11 years and he thought or was told by his appeal lawyer that his BPT date would also reflect that change in his sentence. His BPT Date should have been 12/04 but he found out that he goes to board on 08/12/2009. I am just wondering kind of what happened and if we were given bad info? Does this sound right to any of you guys?

There is a delay due to a Board member resigning. Alot of people that were supposed to go are getting re-scheduled.
I would try talking to your loved ones counselors at the prison their at. Or try calling Board of Prison Term in Sacramento.

Hi everyone!
Well I was told the reason my husbands hearing was delayed "this time" was due to a commissioner resigning and moving on to another position. Don not know the name though, so all his hearings he was going to hear have been postponed and re-scheduled. His next hearing is May 16th.
