View Full Version : Received mail - they want my DNA (and yours too)
Just got a letter in the mail, this is nuts. I'm a federal felon convicted of friggin copyright infringement. They're going to take DNA from EVERYONE who's ever had any sort of felony conviction??!?!? What happened to just violent crimes?!?

This is to inform you that effective October 30, 2004, legistaltion was passed regarding Section 203 of the above-referenced legislation that amends 42 USC 14135a(d)(1) and 10 USC 1565(d) to expand the list of qualifying federal and military offenses that trigger the collection of a DNA sample from federal and military offenders. Under Section 203(b), qualifying Federal offenses are the following offenses, as determined by the Attorney General:
1) Any Felony;
2) Any offense under Chapter 109A of Title 18, USC
3) Any crime of violence (as that term is defined in Section 16 of Title 18, USC); and
4) Any attempt or conspiracy to commit any of the offenses in Paragraph (1) through (3).
Under section 203(c), qualifying military offenses are the following

The new provisions became effective on October 30, 2004 and apply to both the instant offense of conviction as well as any previous federal or military conviction.

It just keeps getting worse.
When my grandson was born, his DNA was taken and put onto a National DNA Data Base.
There is no reason for that. There is no reason you should be forced to submit either.

are you certain of that? our first child is due next month and i specifically asked the obgyn if they took any sort of DNA or other stuff for a database. we were on a tour of the delivery section of the hospital with a group of people and he gave us all an emphatic ABSOLUTELY NOT. they do take the footprints however.

Might be a state thing. My grandson was born in Washington state. My daughter-in-law told me how they take it. Poor baby. Not 30 minutes born, and already giving blood.

I would know I didn't do anything wrong so I wouldn't have to worry about it yet have the peace of mind that another rapist or murderer is off the street. I understand the whole privacy and rights thing but it would be worth it to me.

Boy was I wrong.
In the last three years I have seen two good friends convicted of crimes they did not do...the first because the judge 'believed' a story that was full of inconsistencies, and the second because the Feds threatened to charge the rest of his family if he didn't plead guilty.
It's upclose and personal to me now.

4MyJoe 03-16-2005, 02:53 PM Yes, I know a person who committed his non-violent crime 15 years ago, he's on his last year of supervised released. He is afraid of needles and doesn't feel the need that he owes the federal government is DNA...well the US Marshalls came and took him to jail today for not complying. I'm here trying to find out information about this. This just doesn't seem fair or constitutional....this was passed in October 2004 and it is considered a misdemeanor charge for not complying.
Any new information anyone?

justmad 03-16-2005, 05:26 PM oh geez.... I moved to a different state in October of 2004. If they ever sent me that letter I did not receive it. Can I get into trouble if I moved and did not get the letter? Will they think I was trying to avoid them?? Is it just for Federal crimes or are state crimes included too? Oh my....

I had read a while back that this DNA thing was only for certain violent offenders. Does thiis mean drug offenders too?

I'm a convicted felon and my drug crime WAS counted as violent - my husband too - and neither of us got this letter. Violent based on the amount of drugs, but violent none the less.:confused:
BTW - they don't have to use a needle to get a DNA sample. I think most people now use a swab from inside your cheek and to be honest they can DNA me half to death and they still won't be able to find me guilty on anything. It only took one trip to prison for me to figure it out. This sort of thing is the price one pays (and pays) forever for commiting a crime. Be it lying or copyright; a felon is a felon. It's not like one crime is less/more legal than the other and a so called white collar crime is still a crime.
Over all if this was the biggest problem I had to deal I could say my life is more than okay.

I don't know if this will answer this question or not, but I work on Labor and Delivery here in Nebraska and the ONLY time we take blood for a National DNA Data Base Bank, is when the parents want it. At that they are the one's who have to purchase the kit, which is quite expensive, and bring it to the hospital with them. This ensures that if the child has a disease or illness, and no other blood relative is able to give this child blood, they have access to it. I believe that it never would routinely be done "just because". It's so rare here that even with about 350 births a month, we do this maybe once every 3-5 months. Hope this helped!!
Jetboatracer25 04-08-2005, 10:26 PM I plead guilty to 1 federal count mail fraud (felony). I have no other convictions. I was called into the doctors office on my 2nd day incarcerated to give blood. They say it was now common practice, and wouldn't tell me exactly what it was used for. They told me it was a tox screen and for my own good. I have no drug history or disease or medical problems. I think my phlebotomist was high, she left a baseball sized bruise on my arm and took 6 viles of blood. If I didn't comply I get a shot meaning I lose phone or commissary etc.
Now my PO says I have to give another DNA sample. He says all federal felons must comply or risk probation revokation. This was passed in October 2004. Guess those cold case squads want to make their jobs easier. I think the formal DNA test is a cotton swab (kinda like the one Maury Povich gives you for denying your the father of Shaniqua's baby) so it shouldnt be a big deal. I find it intrusive, and don't trust the feds with my DNA, even though they have every other aspect of my life documented, photographed, fingerprinted, and filed.
We must face the reality. We are the un-wanted of society, we have lost many of our rights, we are now federal slaves. Big Brother will have his boot on our neck forever. We matter not to the fat cats on capitol hill. I'm just a number with a big red flag above it. Every night I go to sleep I hear the cells doors slam in my mind, I hear my reg number shouted out, I hear Lockdown....2nd tier stand up, lights on for count. The sight of grown men breaking into tears, the screams of condemned men will haunt me forever. The mental torture imposed will never be forgotten. I thank god I'm not one of the many sorry bastards stuck there for most of their life. The feds dont mess around, crime certainly does not pay. (at least it didnt for me):cool:

california passed a law where if you were ARRESTED not CONVICTED, of a felony, that a DNA sample was to be taken ............................ WHAT ???? but i do believe, last i heard ........ was that it was put on hold ????? something else to look up ......

jblovesdb 04-13-2005, 01:13 PM I was on juvenille probation in NJ and before I could even get off of it...they had to get my DNA!! You had to be over 18...which I was...and I think it was BS! They also have my man's DNA. I was not convicted of a felon (I was a juvenile) and I had a DRUG charge! It's sooo stupid!
TheGeneralsWife 08-02-2005, 04:36 PM I know in California we passed Prop 36 which said that anyone ever ARRESTED for a Felony would be forced to submit to DNA testing. i think that the ACLU filed an injunction and is appealing it, but because they take fingerprints most people think that this will fly and be held up. We also have PC 286 which allows certain violent felonies to submit to DNA and Blood tests. They went to the prisons and started there and when my brother refused they did an emergency cell extraction, strapped him to a gurney and forcebly took it from him. He was already in the SHU in Pelican Bay so there was really nothing else they could do to him, but if he wasn't there he would have been transfered. A lot of people refused and they treated htem the same way, some were just roughed up a bit more then others.
Anyone know if they can/will check the DNA blood vile from this test
to see if any "SUBTANCES" in the blood sample?
and therefore VIOLATE you with this dna protocal...
or ...is it JUST to keep on file like a fingerprint?? ??
well, they never got me.... i was the original poster, the PO never setup an appointment for me, and the judge just granted me early releasefrom probation. of course while i was in prison they took bloodon a few different occassions, so they probably already have it andjust wanted it again because they're blood sucking vampires and neededrefreshments.

How many times did clinton want everyones DNA taken up and put into a national and even international database to catch criminals.
Now whats the big deal with handing over your DNA? If you dont do the crime, you have nothing to worry about at all.

I have more blood on file with the FBI, US Army, USAF and the USMC than I even have in my body. (In the army, transplanting to the USAF within a year, father was a marine and I got into some trouble as a kid on post :()
You do realize that if you donate blood to a blood bank that sends blood to the american red cross it goes into a dna database which is used to match dead bodies with no identification to family as well as the feds now have access to it to run murders and rapes against.
