View Full Version : husband gets appeal for resentencing....

After only a One year and half wait , my husbands appeal was approved by 3 appellete judges, stating he was over sentenced and that 8months be taken off his sentence. So we have a court date in Sonoma co. on Dec.21 . Does anyone know if he is released that day for time served would have to go all the way back down to CSATF or would they maybe release him from Sonoma County jail ? Also how long does it take for him to get all his processing papers to be released wether from sonoma co. or CSATF ? He has heard it takes up to 2wks. I am so excited I can hardly stand it. :D

I don't know the answers to your questions hopefully someone who does will come by and see this.However I did want to say sounds like GOOD NEWS Congrats :)

This give me hope.. Aaron is waiting for his lawyer . we have no idea what is going on with his appeal.. But I am really happy for you . I hope he is home for Christmas

does anyone know when you would get released ? His court date is dec. 21 so how long after that provided they release him with time served ? Could it happen before christmas ? or is going to take weeks to his processing. He did his fingerprints and blood test yesterday so they are preparing for his possible release.

Wow! I don't know if you ever got an answer to your question or if he is home now. For what it is worth, our lawyer had told us that it takes 2 weeks after the appeal for him to be released. Congratulations! This gives me hope! Take Care and God Bless!

Does anyone know how my brother could appeal his case. He already pleaded guilty but we are sure his time could be reduced. He had a public defender at the time and we feal several issues were over looked. Would I have a lawyer look at the case again? He got 18 years and has served 3 so far. Thanks in advanced.:confused:

Does anyone know how an inmate would file a 1381 form from Wasco State Prison:confused: My husbands sentence was completely stopped. He was originally sent to CRC in Norco and was not accepted into the Civil Addicts program. He was sent to Wasco and now his lawyer says he has to send in a 1381 form to go back to county court and get resentenced. He has tried but nobody can give him one in Wasco. He has been there for almost 5 months there in the reception center with no answers to where he will go next.

Does anyone know what else we could do? We don't even have an exit date yet and he has been incarcerated since 8/09/2003. Help!!

Hi My Friend Is In Fresno County Jail He Is Serving 8 Months He Gets Out December 20 But He Has A Feloney Charge Out Of Merced County He Has Back In June Filled Out A 1381 Form And Has Herd Nothing Yet However I Contated The Merced County Da And Was Toled That Thier Was A Removal Order For Him On Augest 30 But He Was Never Removed She Told Me She Would Look Into It And Get Back To Me But Hasent Is Thier A Cirtin Amount Of Time That Has To Go Bye Before He Can Hear Anything What Shoul We Expect
