View Full Version : Need Appeals Help In Michigan

My husband is incarcerated in one state and has charges in another state. He is in the process of getting the detainer dropped in the other state.

I have heard from many members here whose loved ones have had their detainers dropped with little or no effort on their part.

Well this wasn't to be in my husband's case.

After alot of time, effort, phone calls, money, he was able to file a motion and we just heard back from the Prosecutor who is NOT recommending dropping the detainer.

Of course the final decision is up to the Judge, who we are awaiting on now.

However, in the event, it is negative, we will have to proceed with an appeal and there lies the problem.

We will have 30 days in which to do so and without legal books from that state, or an attorney from that state (Michigan), all seems to be lost.

If anyone has any suggestions or knows of any Pro Bono Attorney in Michigan, please contact me.

We had hoped that they would appoint him an attorney, but so far none has come forth.

He feels that he is getting a raw deal because they know he is incarcerated in another state and has no access to legal books in their state.

He has already served 7 years and unless this detainer is dropped will have to serve another 9 years.

I cant imagine going through this. It is a nightmare. I try to boost his spirits and tell him that there will be a way, knowing in my heart all seems to be very futile at this point.

I am in Mich.Im' will do some searching monday morning and ask LT what he can find out on in the inside.Sometimes they know things/heard of someone hrough the prison grapevine that we dont' .If I find anything out I will get back with you.What County is this detainer in? that migh help a little

Bless you. It is in Montcalm County. The good thing is his Michigan time is running concurrent with his time here. The bad part is that wont help if he gets out here and has to go back there.

And he stands a real good chance of getting released here very soon.

Anything you can do will be appreciated. I thank you and my best to you and yours.

I'm sorry but I don't know of any pro bono appeals attorneys in Michigan... Our's is costing us lots... Positive thoughts being sent that you find one soon...

Thanks Deb, I appreciate the positive thoughts. He does have a real good arguement for having the detainer dropped in Michigan, it is just a matter of getting it in the right format and the correct language. I definitely do not have the legalease to help him. He does have the typewriter to type it.
I am going to make some phone calls and see if there is anyone there who would at least be willing to point us in the right direction.
I dont even think we would absolutely have to have an attorney if we just had access to the legal books.
My husband does have a good legal aide who is helping him, however, this inmate knows nothing of Michigan law and as you might guess each state is different.
I havent given up hope, but it is looking very dim here.
I am just like everyone else I would gladly give anything to have my husband home with me.
