View Full Version : Need help with services, registrations, etc...time limits!!!!
crbdt 11-19-2004, 02:33 PM Shayne got home on Tuesday, and Wed. begin going to Soc. Sec., TRC, TEC, to apply for benefits, services, etc. as he was instructed to do through the Law Library at his facility. There are required time frames...30 hours for this, 10 days for that etc. and so far, he has hit walls at every location. Oour question is: Is all this legal information they are given inside just out and out lies? Or are we not doing something right? Does anyone have any information on this stuff!!! Please help, ASAP
Thanks,
Catherine
bellisq 11-19-2004, 07:33 PM Congratulations on your good news. I didn't understnd what you were applying for in terms of benefits, etc. I think the real directives will come from the probation office in terms of what Shayne needs to do. Maybe you could explain a little more and someone will be along to help you.
is he getting out of fed or state (which one) system?
In general what you are describing doesn't sound familiar...

crbdt 11-19-2004, 11:09 PM Someone in the Law Library gave him written information telling him to go to SS to apply for temporary disability guaranteed by the Fed. Govt. in that all incarcerated individuals are "mentally afflicted" temporarily or possibly permanently in that they cannot conform to the legal system as others, to TX Rehab Commision because ex-offenders are entitled to small business loans if they wish to start businesses, and to get schooling and so forth to assist with getting employment, and to the TX Empl. Commission because ex-offenders are automatically guaranteed unemployment payments as they have been incarcerated until they find employment. This was all documented information. However, some of the people he has talked to says they know nothing about it...as the law librarian told him they would say. Anyway, we just want to know if anyone has ever heard of this stuff, and could advise on it. We have all the law reference numbers and so forth!!!
Thanks again!

bellisq 11-20-2004, 01:36 PM Laws can be on the books but be unfunded. If you call the local office of your congressman's office and/or state legislator's office on Monday, they can tell if any of these services are functional. In Florida, it takes years to get even temp SS, with an automatic rejection given the first time. I doubt TX is much more accomodating. You might put your request on the Tx forum and see what anybody knows there.
Good luck. It would be good to let us know what you find out.

SerenitysDancer 11-20-2004, 04:24 PM Your man can apply for Social Security Disability or SSI, generally the wait time for an answer is 120 days. There is NO guaranteed he would be approved since approval for this money is dependent on the defintions Social Security sets as being disabled. He would have to submit proof of having issues, whether he had received a copy of his medical record file before he left incarceration, any assistance he received inside whether through the medical clinic or psych unit, affidavits from individuals who can attest to his difficulty of being incarcerated etc. You have to have proof, or him getting assistance from Mental Health, doctor since he is free now, what is he doing to get help for his issues in dealing with it in the free world? That would be a question.
What other benefits or services is he hitting a brick wall in getting? Hope been helpful. Good Luck.
