i really appreciate this site. my little brother just started his sentence 11-15-04. the story of how this mess came to be is pretty wild. first off my wife, daughter, and I moved to arkansas in january 2001 from ohio to be with my family (dad mom & brother) for alot of reasons, but mainly, my mom was 48 and had colon cancer that had aggressively moved to her bones and liver. we thought we would have more time with her, but she died 9 days after we moved here. my brother has lived at home to this day, he's now 23. he was always moms boy. my father remarried almost 2 years later to a very nice woman who has 2 kids, 16 yr old boy and a 13 yr old girl. my father moved into her house leaving my brother (at the time 21) and her two kids to live at my dads house in the country. this is where it gets intersting, my brother was in his rookie year of being a county deputy sheriff. he was payed 99 cents a month for a year and did everything the full timers did. my stepmoms kids were having their friends over to the house while my brother was on patrol. one night he comes home with one of his real good buddies (age 20). there were some girls and guys over that night hanging out with my stepbrother and his sister. the two girls ages were 14 and 15, and have the type of reputation for dating older guys. although my brother had never met them. the girls reacted with comments towards my brother sexually. a couple guys, including my bro, flashed the girls after repeatedly asking them to. he ended up with one girl, but it didn't go to far, because my brother realized she was too young. so he didnt give her what she wanted from him. he made some mistakes that night, but stopped it before it went too far. about a year and a half later, his "good buddy", out of the blue, goes to the city police department which my brother was currently applying for a full time position. the "buddy" told the police about that night, but added alot of false details. the police called my brother in to talk about his background check, but instead arrested him when he got there. entrapment is actually legal in arkansas. my brother told the truth about what happened that night to the police, but they bought the story from the "buddy" and the girls. we later found out that the girl my brother turned down offered the "buddy" some lovings if he would get my bro in some trouble, and that they would back him up. being that my brother was a cop, they persacuted him in the papers and the news. the sheriff actually accused him on tv of using his uniform to perform acts on young girls. to beat it all, the prosecutor was up for election at the time. for instance, his bond was $250,000, where a murderer's bond a week before was $125,000. we got him out figuring we could fight this with no problem, except what he admitted. 7 felonies was dropped to 1 misdemeanor (sexual assault on a child), and 2 felonies (sexual exposure to a child), which means under the age of 16. because he was a cop, and they have a confession, his lawyer advised him to plea bargain, and also to help keep it from being a high profile case and a juror screwing him. they got it from 18 years, down to 12 months in county jail for the misdemeanor, 6 years in a state facility for each felony, one 6 year term suspended. his lawyer told us if he is good he will only have to serve 1/6th of each term. that means he could be out in 13 months. that would be great, but it scares me that it won't happen like that. during his court dates we had numerous continues. due to the fact it was well known the supposed witness ("the buddy") was dating the supposed victim. and also some of her friends. thing is that he is sleeping with these girls, spending the night at one of thems house, he's out in public with them constantly. (yeah, i had a hard time not taking justice into my own hands). the guy is committing more than what he turned my brother in for and getting away with it. the girl has also filed rape charges on another young man recently. we've even produced pictures of these two together, and numerous pics of the girl with older guys, giving to us by one of her friends who doesn't think its right whats happening to my brother. and she's not the only one like that. the judge almost didn't accept his plea bargain, so we know we did the right thing. i love my brother, i missed 8 years of his and my mothers life except on the phone, because of the distance between us. i finally get here and i lose them both so quickly. im scared for him in prison. i dont think he belongs there, but he is in good faith that he can get is 13 months done and come back home. its bad enough he has to register as a sex offender the rest of his life. i sometimes think that if mom was still here, this wouldn't be happening. stay strong, im trying.
