Hi,
I am fairly new here and I have a question. My son is in Butner NC and My husband and I live in Maryland. When the time comes, my son can go to a half way house, which he would like to do in Maryland, since we live there. We are retired and plan on moving to Delaware, which is a little over an hour away. My concern is will he be allowed to come to Maryland's half way house even though we will be living in Delaware. Does he half to be close to family to go to a half way house? Appreciate it if someone can advise me. Thanks

Poe1...I don't have an answer for you, I do believe the release address has something to do with it but can not say for sure so I'll leave this up to someone else. We do have a member with someone in the CCC is Baltimore, hopefully someone will be able to assist.

I can't answer for Maryland, but I interned with the Department of Corrections in Washington state. In order for an inmate to be transferred here from out of state they need to ask for permission and they need someone in the area they are moving to. The DOC will also consult with the victim before allowing them to move. Here the victim can request that the offender not live within a specified mileage of them (depending upon the crime). My son's victim can request a 500 mile boundary around her and if she lives near us, my son will not be allowed to live with us once he's released. (We don't know where she lives anymore. We just know that she moved to OR, so if she happens to live within 500 miles of Vancouver...)
Since we live in Vancouver - near the Oregon border, I can also tell you that Oregon generally refused to allow Washington inmates to move there. At least they refused to allow any of the inmates we requested permission to move to Oregon....
Hopefully, someone from Maryland will be able to give you a better answer. You can always call the Maryland DOC and see what they say.

In order for an inmate to be released to a district different than that in which they were convicted, they would need to have their case transferred "for release purposes." This is a BOP function and is initiated through the counselor. The Probation Department will do an informal investigation for family ties, etc.
