These offenses are noted on the grids. It is important that Manufacturing Methamphetamine and Drug Paraphernalia Used to Manufacture Methamphetamine be specifically noted on the Judgment and Commitment as it is a subset of the statute and the DOC will not know to apply this release criteria unless it is noted on the commitment. The Methamphetamine offenses were originally scheduled to sunset on April 30, 2002. However, Act 1782 of 2001 repealed the sunset provisions. (See A.C.A. 29-30-162 and 29-30-163). Act 717 of 1999 provides this statute may be waived for juveniles convicted as adults who were merely accomplices. Offenders sentenced to a Regional Correctional Facility via judicial transfer for Paraphernalia used to Manufacture Methamphetamine are still subject to 70% parole eligibility. Here's the link: http://www.arkansas.gov/asc/faqs.html Hope this helps. Don't know too much about the 70% law except that it's a ridiculous one. TBS 11-09-2004, 09:54 PM Thanks for the info. My b/f said alot of the guys in there were asking. he thought that they were saying that they did away with that though. I have no idea. Jade01 11-09-2004, 10:00 PM I'm almost completely sure that the 70% law is still in effect. Hopefully one day though that will change. TBS 11-09-2004, 10:02 PM Well I don't think the guys are going to be too happy to hear that. Thank you for the information. juliwaits 11-12-2004, 12:46 PM TBS, if you're wanting to know if it was on the general election ballot on Nov 2, it wasn't. probably just an inmate rumour. his_lil_sis 11-13-2004, 06:33 PM Hi, I am the sister of an inmate at Tucker unit, my brother is also serving 70% of a ten year sentence for aggravated robbery, under 70% he must serve 7 years. I am a new member to FAMM (family's against mandatory minimums) they will keep you updated on any and all information about 70%...they are trying hard to change it.I just visited my brother today, we were discussing the chnages that ADC is considering to make and 70% is one of them...it was in the state paper just a couple of days ago.. What unit is your b/f in and what charges ? I may can help with more info....just let me know...Shirley TBS 11-13-2004, 06:59 PM He is at grimes unit. I don't think his charge falls under the 70%. It was poss/ with intent to manufacture. But he said alot of the guys in his barracks do have and they were asking. juliwaits 11-15-2004, 12:44 PM TBS, a LOT of people with drug charges get stipulated for 70% It's also called "doing time on the Y" pods 11-15-2004, 02:17 PM Hi, I am the sister of an inmate at Tucker unit, my brother is also serving 70% of a ten year sentence for aggravated robbery, under 70% he must serve 7 years. I have seen the website (nationally) & it sure sounds like there is going to be discussion of the 70% this coming legislation, my fiance' is at tucker, too, he's at tucker max. pods pitprincess 12-10-2004, 07:36 PM My cousins are both in on repeted offenders on Methamphetamine offenses, My friend just explained to me 15 mins ago about the 70% before I found this post. Thanks for the helpful information you all give :) Jonesz's Wife 06-09-2005, 02:39 PM I followed some of the legislation this year hoping that my husband would benefit from it. He is under the 70% on a meth charge, but they did pass the bill that allows for good time to be awarded up to 50% of their original sentence. The guards keep telling them that their time is fixing to change because of it eventhough it doesn't state that it is retroactive. What is really screwed up is that this same law takes the 70% OFF OF KIDNAPPING and that part IS RETROACTIVE!!!! Just seems odd that kidnapping would be considered less serious than manufacturing...maybe that's just me juliwaits 06-11-2005, 09:00 AM yep, i've decided with regard to ADC's policies that you cant say "oh, that makes sense" because so many are inconsistent and/or illogical. |
