"Fix Three Strikes" Battle Continues After Proposition 66 Setback


Supporters of reforming California's three strikes law vowed today to continue their fight to fix the flaws in the law, despite the defeat of Proposition 66.


"Nothing ends today," said campaign leader Joe Klaas, who has battled for 10 years to enact common sense reforms. "Opponents of Proposition 66 pointed to specific things they opposed in this initiative, but always acknowledged the flaws in the three strikes law that still need to be fixed. Those flaws remain and this fight goes on."


Klaas attributed the measure's defeat to the huge campaign of fear and disinformation in the campaign's final days, enhanced by the celebrity power of a charismatic governor, which all but drowned out supporters' common-sense message of reform.

Proposition 66 supporters pledged to redouble and broaden their efforts, reaching out to opponents—legislators, district attorneys, editorialists--who acknowledged the serious flaws in the three strikes law, to find solutions that can and will be enacted. "It's still as absurd as ever to give shoplifters and petty drug offenders the same sentences as rapists and armed robbers. We now ask Proposition 66 opponents to work with us to preserve three strikes and fix these unjust flaws."

qwerty..i was just going to post about...the need for continued activism

really in all/many/some (whatever, one can do) areas that concern us..

ie: the vietnam war ended under nixon and ford=big on war....but, the huge peace rallies, demonstartions...writing to their representatives..the president had to finally listen...same with women getting the right to vote, black civil rights....etc.

don't leave decisions in the politicians hands...this is our democracy...they are suppose to answer and represent us!!!!

i am sorry to all who needed 66 to pass!!

Francis is so right... those of us old enough to remember Vietnam know that it took MANY years of protests and fighting, but we did win in the end.

I try to tell my young friends that we kept on going despite what seemed like impossible odds for so many years.

I remember being a little kid, standing with my mom and the Quakers to protest the war and people would drive by and spit on us!

UNPROCESSED BALLOTS *The following report is a county-by-county estimate of the number of ballots remaining to be processed to determine the final vote. Processed ballots include absentee ballots and provisionals, which are in the process of being checked to determine a voter's eligibility to vote.
These ballots are only counted after eligibility is determined. The numbers listed below are estimates -- in some cases rough estimates -- of the number of ballots remaining. Counties are not required to report the number of late absentee ballots to the Secretary of State's office, but they have been encouraged to do so to provide the public with an approximate number of votes that remain to be counted. In California, county election officials have 28 days from the date of the election to complete the final canvass of votes, however, the final results in most races will be determined well before that deadline. The extended period of time to review the ballots is required to ensure that the election officials are able to verify the signatures of voters on absentee ballots against the signatures on voter registration cards before the absentee ballots can be opened and counted. Please keep in mind that the numbers of unprocessed ballots are ESTIMATES providedby the counties immediately following Election Day. In some cases, the number of unprocessed ballots may be much higher or lower than originally estimated. Original estimates will be updated as we receive more precise estimates from the counties. The numbers provided in the "Remaining to be Processed" column will be updated as we receive new information from the counties as to the number of ballots remaining to be processed.

I downloaded the pdf, wow.. as of 9:30 this morning there were almost 1.8 million ballots left to be processed and counted in Cali!!!

Now (as of 11/5/04 - 9:30AM) there are nearly 1.8M unprocessed absentee, provisional and damaged ballots. Some of the counties with large numbers that could swing our way on Prop 66 are:

Alameda - 95,000 unprocessed - currently at 59% Yes and 41% No
Contra Costa - 57,201 unprocessed - currently at 50% Yes and 50% No
Los Angeles - 400,000 unprocessed - currently at 50% Yes and 50% No
Marin - 31,100 unprocessed - currently at 59% Yes and 41% No
San Luis Obisbo - 29,000 unprocessed - currently at 53% Yes and 47% No
Santa Barbara - 56,111 unprocessed - currently at 57% Yes and 43% No
Santa Clara - 207,000 unprocessed - currently at 50% Yes and 50% No

Those with large numbers that are currently running No - hoping for a turn towards Yes

Riverside - 115,500 unprocessed - currently at 39% Yes and 61% No
Sacramento - 125,000 unprocessed - currently at 43% Yes and 57% No
San Bernardino - 109,100 unprocessed - currently at 36% Yes and 64% No
San Diego - 228,917 unprocessed - currently at 42% Yes and 58% No

Several counties show up as 0, such as Orange. Not sure if they have all been counted yet or if they haven't reported yet.

All I can say is we have to watch these results very closely and.......

and click on absentee ballot status.

Right now (5:17 pm today) the difference between No and Yes is 613,887 votes.

With the number of absentee balloots that have not been counted WE CAN STILL WIN THIS!! When will we find out if Prop 66 passes?
It is so close! Is there something being done to ensure that they do count them and don't leave the numbers the way they are.

The state has up to 28 days to count all the ballots. Hopefully, it will be done sooner!

I just received this E-mail:

Dear Secretary of State Mr. Kevin Shelley

We learned that Los Angeles County
Registrar-Recorder's Office began counting 300,000
absentee ballots and an unknown number of provisional
votes cast, only today.

Counties throughout the State also have an unknown
number of absentee and provisional votes yet to be
counted.

Given that Prop. 66 is behind by a few hundred
thousand votes statewide, in theory,it is
mathematically possible that the total votes on all
propositions cast have been under counted and that the
public can be misled by the media.

It is your political and social responsibility to
assure the integrity and the accuracy of the total
votes cast.

We therefore call on you to have a press conference to
assure the public that all absentee (domestic and
foreign) and provisional votes will be counted and
that no official announcement of the total vote be
made until then.

We request that you mandate all counties to count all
absentee and provisional ballots before a final vote
count is announced and that the public be allowed to
monitor the vote canvas.

We also learned that votes cast by the military
(soldiers) registered to vote in Los Angeles County
will be transported directly to Washington D.C. by a
private corporation and by-passing the Los Angeles
County Registrar-Recorder's Office. If this is not
illegal, it should be and at the very least has the
appearance of impropriety and further erodes the lack
of confidence by the voting public that our votes will
not be tampered with. Please respond with your
comments.

This is what I sent to the Governor.....

Even if the vote does not abolish prop 66....doesn't the fact that the numbers are so close warrant a serious look into what we can do to improve the specifics pertaining to prop 66. For example, not all 3rd strike sentences of are of a violent nature at all! Don't you agree that a sentence of this extreme should only be considered in violent cases or cases of rape! Do you have any idea what it is like to spend one day in prison, let alone a life time!

Lies and Fear Did In Three-Strikes Measure

November 6, 2004

The low road was taken to defeat Proposition 66 when bald-faced lies were used at the last minute, giving supporters no time to refute them. What lies? (1) That any murderers would be released. The sentence for murder is a minimum of 15 years to life and has nothing to do with three strikes. If there were a three-strikes conviction, it was after the first life sentence for murder. (2) That 26,000 would be freed, including two-strikers who were not part of the proposition. In fact, only 4,000 were eligible for review and possible resentencing.

Up until two weeks before the election, those against the proposition complained that one individual had put up more than $1 million to have it passed. Where was the hue and cry when an Orange County individual poured in several million to defeat it, aided and abetted by the [prison] guards union? Nice timing but hardly ethical and certainly not honest; just another scare tactic from the broken criminal justice system.

The defeat of Proposition 66 is the saddest result of this election. Fear-mongering has brutalized the majority of voters of California and made us mean-spirited. Any lingering support I felt for our popular governor is now terminated.

I had always assumed that the "Three Strikes" battle would continue.
I have to say that I am still depressed that something so obviously in need of fixing would be upheld by failing to pass Proposition 66.
Even accounting for the disinformation...which were really malicious lies, it and the re-election of B**h (for me its a 4 letter word) ---which was also aided by lies, has depressed me as much as almost anything that has happened in
my life in the past 15 years.

Thank god this is not going to just be swept under a rug and forgoten about. Alot of men and women in prisons have the attitute already that this is a done deal. Let's fight until this law is finally fixed. Whooooo. And I still think that our govenor is a freeking joke
