My son is in a federal prison in CA. Things had been going ok for him and then he got beat up by another inmate a few weeks ago. He has been placed in solitary since Oct 7th and no one will let him know what is going on. He was told there might be a 201 fighting charge brought against him?,Does anyone know what this means? Or where I can find out anything for him? He wrote and said something about a BP-10 appeal if they try to charge him. Any help would be greatly appreciated.

Actually, the sad fact is, in the federal system, if you get into a fight, whether or not you started it or the other person did, you are viewed to be just as guilty. Not fair, I know. I would go ahead with the BP 10, but he must first file a BP8, then go to BP9, etc.

If both inmates receive an incident report, and the charges are of the series 200 variety, the appeal from the DHO's decision is by way of a BP-10 - not a BP-9.

In the event he got beat up and the fighting was not mutual, he may not get an incident report at all. He probably will remain in SHU for several weeks in either case.
