evader 01-14-2003, 08:23 AM Hi all, My son is in texas prison. Last year Jeremy came up for parole. WAS DENIED, and given a serve all. Which means, he gets out on his Projective Release date. The state moved his Projective Release date from March 3,2003, toOctober 2003. Every month the state adds SIX days to his time. Jeremy's Projective Release date is now Nov. 11,2003. Jeremy is on a no work farm. Telford Unit, New Boston, Texas. The prison said they add the six days every month because Jeremy is unable to work., and because he is in Ad Seg.. Jeremy has been in Ad Seg, for three years now, for being tagged as a gang member, because, he got jumped by three big guys, and he fought back. Jeremy told me if those guys would of had shanks he wouldn't be here right now. It's ether fight back, or die ,or get puncked out. This is the same prison, same year, Rudy Delgoto got brutally murderd, Then the prison lost the body for a week.Does anyone know if it is legal for the state to keep adding time to my sons Projective Release Date? Jeremy Classification is a Class line 1, S4. The highest you can get. Jeremy has had no Major cases in the last three years, since being locked in Ad Seg..

Welcome to pTo. Yes it is. When they are housed in Ad seg. they add 6 days to their time. It is legal. My man is also in the same boat. He gets out Feb 20th. If there is anything i can do, please feel free to ask

pookie 01-16-2003, 10:27 AM Welcome to PTO!! Your situation with your son Jeremy seems to be identical to Tim's experience. Tim had to fight back too and was put in Ad Seg for being a gang member. He says if he hadnt, he would have been eaten alive in every possible way. Tim is in a federal prison now, but was in TDCJ before that for 10 flat years! So I am very familiar with how TDCJ operates. They add on those days every month, just like you say, and they cannot keep accurate calculations worth a damn!! And this is the truth!! You can call one day and get a total different answer the next day when it comes to getting the accurate release date. They are aggravating, and frustrating. They dont give a damn about calculating inmate times with ultimate accuracy. Forget it!! Actually, the more you call TDCJ, the more they seem to find so called "errors" in their calculations. An employee there has told me on a personal level, that it is best not to attract attention to the time, because they add on more days thinking that they made a mistake in the past!! I wonder if they had loved ones who if they were instructed to correct their time, would they screw up as much. Well we already know that answer don't we?

evader 01-16-2003, 12:11 PM Thanks for the info. . What gets me is last year Jeremys progective release date was March 3,2003. Now it's Nov. 23 2003. I added 6 days a month for this year and came up with Feb.3, 2004. Then I hear that they don't have to let them out on their projective release date. It is just frustrating, because he was wrongfully convicted to begin with. Jeremy has lived in prison 7 years for a crime he didn't even commit.
evader 01-16-2003, 12:16 PM I was thinking of calling classification at the prison, or Nancy Hays, head of parole board in Austin, to find out about this very screwed up system TDCJ has.
The law has changed, Any one that was sentenced after 1996, they are no longer released on projected. The parole board now votes on wether they are let out. You son was sentenced 7 years ago, there for this law does not apply to him.
When your adding up calculations, they go back formt he day they were sentenced and they take into concideration there good time as well.
