Can anyone tell me what this means?

ORDER signed by Judge Griesbach on September 29, 2004. IT IS ORDERED that Claim Three of the Petition is hereby dismissed. IT IS FURTHER ORDERED that the U.S. Marshals Service shall serve a copy of the Petition, a waiver of service and/or summons, and this order upon Defendant. IT IS ORDERED that the Defendant shall file a responsive pleading to the Petition. IT IS ALSO ORDERED that copies of this order be sent to the Warden of the Institution where Petitioner is confined and to Greg Weber, AAG.(cc:all counsel)(mec,) (Entered: 10/01/2004

Thanks so Much!

It's an Order by the judge ordering that the petition be served on the defendants and they have to answer it. It also means that whatever the petitioner stated in his third claim was dismissed by the judge, and therefore won't be able to be an issue in court.

The definition of habeas corpus is: A legal writ or court order to release a prisoner from allegedly unlawful confinement so that he/she can appear b4 a court for proper remedial action. The prisoner seeks release.
Hope this helps!

The way I read it it says, claim 3 is dismissed, but the rest of it is still open to discussion. WHY they can't just SAY that...disclaimer- I could be wrong.
