Just got off the phone with someone with FAMM and she stated that the Supreme Court ruled yesterday that Federal prisioners were not getting the good time credit that they should be and this will mean that some inmates will be getting out immediately. I have not checked any of this out but she said she heard it on the news. If this is true I am sure there will be a lot of happy people out there!

Wow, I hope it's true, but I wouldn't hold my breath yet. Why doesn't FAMM have this on their website? I've been surfing for a couple of hours this morning and haven't come across this anywhere :confused: We can always HOPE though!

I don't know why. The lady I spoke to was a local coordinator, so I could not say. If you find out this is not true let me know. I just don't know why she would tell me this if it wasn't.

Well, let's hope it's true until we find out otherwise :) I vaguely remember the appeal an inmate won regarding good time credit, but I think I read here that the BOP would fight it. Wouldn't get my hubby out right now, but sure would be cool if other's could.

There was nothing in the Supreme Court about this, but in the 9th Circuit. Kieffer posted it. Here is the link.

There was a case in Wisconsin where they fighting the BOP's interpretation of good time credit. I believe the DOJ appealed the decision of the lower court, which was against them and I believe that the Supreme Court denied the DOJ cert, which means they refused to hear the appeal and are allowing the lower court ruling to stand.
I could be mistaken, but I believe this is what happened and that is why the lady said tha the Supreme Court ruled against the BOP. Technically they didn't rule against them, they just wouldn't hear their case.

This appeal is pending in the 8th Circuit- as is at least one other on the same issue. The law in the 9th Circuit is not good because of a particularly bad decision. There are other cases, in other areas as well. This is an unsettled issue - but the applicability depends upon the inmate's location.
