Hi,
I would like to know how long my boyfriend can be away for since he violated his probation by having a drink now and then (at home, no driving, not leaving his house)? Oh, I can't forget to mention his PO said that it didn't make him worry that he would have a beer on occasion.
Another officer who searched his house reported him and he had to go to court this last week. Nothing was defined. He needs to go back by the end of this month and meanwhile they will think what to do with him. His PO is a reasonable man but I was angry he didn't say anything in court to favor my boyfriend, he was just trying to cover his a**, I believe...ARGH!!!! :blah:
His attorney said the worst case scenario is 1 year in jail and since I heard that I can't sleep or eat anymore. A 30 day sentence I can handle, but 1 year is absurd and too much for my already very feeble health :( and to make things worse I live in another country :eek:

I cant be certain and nothing around here is consistant, but I dont think they will put him in jail for a year. The jails and prisons around here are so full right now they are doing everything they can to keep people out. Some of it will depend on the judge. I know of someone who had more then one probation violation and the judge just made him sit in jail for about 30 days then added time onto his probation. Another one got time added on his probation, but also had to do 120 in a boot camp type program. Both these guys had the same judge and neither of them had been in prison. I know of anouther who actually was on parole got many shots at messing up before he was ever put back in prison.

Its just hard to say what to expect at this point. As I said before the best thing is make some contact and see what you can find out. From my experience there people are more then willing to work with us and help us understand.

I will talk to my boyfriend tonight and see how he feels about me introducing myself to his PO and being at his disposal to make my boyfriend's probation a success!!

If, for some reason, my boyfriend goes back to jail for violating probation (minor violation), can he appeal?
Let's say if he gets 3 months - 1 year, can his attorney try and reduce this period to a month or maybe a week?
He already spent 24 hours in jail when he told another PO (his was off that day) he had a beer with dinner.
The first time he went to court for this minor violation, they let him walk out free while they decide what to do with him. Now, 3 weeks later, I'm feeling sick to my stomach and praying 24/7 he walks out free again :broken:

I really dont know if a parole violation can be apealled or not. I know your worried about how things are going to be, but I have seen many who go to court for violations and bigger then a can of beer and still only get 30 days county jail. Right now the jails here in ada county (Boise) are so full that I would be shocked if he got even that over 1 can of beer. I would think that even in the worst case senerio he would get a 6 month rider. I also think that a lot of what happens depends on how well he has done on probation up until that beer. If that 1 beer is the only thing he has against him then the judge may give him a strong warning.

When does he go to court?

He goes on Monday, Oct. 25th......you would be surprised at how many illnesses I found out I can have out of stress :yuck:

I just found out my boyfriend was arrested for DUI while in probation. That is why the state was so harsh oh him for violating...they want him in prison. We want him in treatment!!! He has to deal with this drinking problem oh which I just realized and putting him in prison will just delay his recovery.

Tonight, I didn't pray for his release...I prayed for sentencing him to treatment!!!! He needs that in order to get our lives back on tracks....
I'm so disappointed he didnt tell me....he was way embarassed but HEL-LO?! Im the woman you're going to MARRY, darn it!!!!:mad:
