Juvenile Committment Criteria

Minnesota Laws 1997, Chapter 239, Article 9, Section 45 has mandated that by January 1, 1999, the commissioner of corrections shall develop admissions criteria for the placement of juveniles at the Minnesota Correctional Facility (MCF) at Red Wing (RW). Draft admissions criteria and a report were due to the legislature on February 15, 1998.

MCF - Red Wing commitment criteria have been developed for juvenile male offenders committed to the commissioner of corrections. Sex offender criteria is included in the commitment criteria as the MCF - Sauk Centre sex offender program will transfer to MCF - Red Wing on October 1, 1998. The department will implement the new commitment criteria January 1, 1999, and will also seek legislative language regarding this issue during the 1999 legislative session. Although the criteria is permissive, not mandatory, please begin to apply the folowing criteria at this time to assist in an orderly process of implementation. A full report regarding the development of the commitment criteria is available upon request. Please note that commitment includes a mandatory 90 day residential community placement.

Juvenile Commitment Criteria

Serious Offenders (not including sex offenses):


Juvenile offenders who commit offenses, which if they were an adult, would be included in Severity Level VII through X of the Minnesota Sentencing Guidelines (presumed imprisonment) or
Juvenile offenders whose offense and offense conditions if they were an adult would be included in M.S. 609.11 (minimum sentences of imprisonment) or
Juvenile offenders whose offense and offense conditions meet the standards established in M.S. 260.125, Subd. 2a (2) (any felony offense committed while using a firearm) or
Extended Jurisdiction Juveniles (EJJ)
Chronic offenders:


Juvenile and/or EJJ offenders who have two or more current or previous felony-level offenses and
Have experienced at least one prior court-ordered placement in a residential program which has an expected duration of ninety days or more.
Sex Offenders:


Adjudicated for a sex or sex-related offense and meet at least one of the following criteria:
Failure to complete court-ordered residential sex offender treatment.
Has been court-ordered to complete treatment but cannot gain admission.
Following a sex offender evaluation, may be admitted as most appropriate treatment option.
All youth committed to the commissioner’s custody whose offense(s) include loss of life will be reviewed individually for length of stay determination per commissioner approval.
MCF-Red Wing will require that youth committed to the commissioner’s custody complete a 90 day residential community placement during community transition.
