If the law does pass in November, They will resentence the lifers, but the guys that are charged w/a non violent felony doing 2X the normal sentence for enhancements, how will they let those guys out. I read the law it says only lifers are to be resentenced. I know my husband is eligible to get out because Ive already researched that.
? is how will they release all those whos sentences were doubled because of prior strikes, and the crime was a posession which after the law passes it wont be a violent crime? I think the courts would be packed. :confused:

I have heard that they are going to do them in the actual Prison! BUt who knows could be a rumor!

I contacted Jim Benson the chairman with Three Strikes and he told me that each county would handle the cases differently. He advised me to contact the county in which he was sentenced if the law passes.

I've been told that only those inmates who were already sentenced to 25 years to life or more will go back for resentencing. there are only about 4,300 inmates that fit this category. those who were sentenced with 2 strikes will have to do the time that they were sentenced to in court. but tell me if I'm wrong!

It was my understanding if the inmate is doing an enhanced sentence due to a second strike that he would get resentenced also to remove the enhancement.

From what the legal begals have been telling us at FACTS, Prop 66 will only affect the 3rd strikers. However, you never know what the courts might do and if they set a precedent, it may open the doors for 2nd strikers down the line.

the law does not apply to one crime and not to another. If you hare in on a 2nd striked for a violent felony under the prop 66 you will not be eligible to be resentenced, but if youn areon your 2 strike and you crime is NOT a serious felony under prop66 YES you can get resentenced, becaused if this wins the law that put you there does not exist anymore. so by law you can be resentenced. dosent mean youll get less time. Laws affect everyone not just who they want. there is more to the 3 strikes law than the 3rd strike. VOTE YES ON 66

With sadness I see that some people do not understend the prop 66 at list people who does not have a love one in. A lot of nonviolent inmates put their faith in this prop 66 to be pass,so please vote YES...

I guess I am confused as well since not living there but I have read the proposition and still I am unsure so perhaps someone that lives there can help me with this.

My man was sentenced to 27 years doing 87%
there are 12 counts on him from what his paperwork says BUT no where do I see where it says anything about the strikes listed he says he doesn't believe they listed this in the strikes as all the counts were as 1????? IF I understood him correctly.

He was given massive amount of time due to enhancements so will he qualify????
I have to record his POA on the in November in the County he is at the prison but it is notorized and I understand it does have to be recorded at the court house also, so until I get that done NO lawyer will discuss anything with me. So I hope someone can help me with the answer WILL he qualify?

If I understand the situation correctly and if he only received 1 strike, then no he won't qualify.
