Help,
I need help to get my visits back. I was trying to visit my Bf and was pulled out of line becuase the girl I carpooled with had contraband. I had no idea becasue it was the first time we carpooled. Well supposedly they had search warrants for her and I which I never saw but was still searched. I came out clean of course but was still detained for 8hrs by the prison. Then found out they were trying to press charges against me becuase I transported her in my car and that I should have known all the contents of my car. I told the prison what am I supposed to do cavity check all passengers. So anyway went to court and of course it was thrown out so now i called the prison just to check my visitation status and I was told it was suspended. Never received any paperwork nor did he. It was pending my court dates and the outcome. Well I told them that court was over and I am free and clear with the paperwork to prove it. The co then tells me that i still cannot visit because of the prsion in house investigation. I told her but you just said it had to do with court now another story, what in house investigation. She told me that what the courts do on the outside is different then in house investigatgion. So i asked her well how much longer is has been 8mos...her answer I DONT KNOW...

Is there such a thing as in house investigation? If the courts cleared then what is the prisons problem. How do I get information to settle this,nightmare.

I am sorry this happened to you.
A good lesson for the rest of us, but that doesn't help you any, huh? :(
I hope someone comes along that can help.

I do believe there is such a thing as an in-house investigation and I know that they do take time.
Have you considered contacting the Ombudsman for that prison and asking for some direction in this?
You might also do a search in the regular California forum about this. I remember another member who faced the same situation about a year ago or so...just can't remember who it was. But I do believe she got her visits restored. I'll do a search and see if I can find anything and if I can I'll post it here for you.

Well if it is like the investigations they do on staff it could take over a year.

How long ago was it? They will often pull the priviledge for 90 days. Because as they are soooo fond of saying "visits are a priviledge". But the advise about contacting the Ombudsman is good. That's always a good phone number and address to have on hand.

It has been since Feb of this year. I have tried over and over to contact the Ombudsman but no luck. I did nothing wrong the the courts have agreed so where does the prison get off thinking they are above the law! I did what I was supposed to do as a citizen. THey are just on a witch hunt.

You need to write a formal letter of appeal to your denial of visitation to the Warden of the prison. If you are denied by the Warden ( I believe they have either have 30 or 60 days to respond) then, You send a formal letter of appeal to the Director of Corrections ( same thing applies, either 30 or 60 days). If your appeal is once denied again, you can re-apply for visitation every six months, again working on the appeals after each denial. Keep up with the letters and keep a paper trail. Make sure to send along copies of your court docket with each letter you send off.
