View Full Version : Application To Live In My Apt__denied
angel 2004 08-28-2004, 01:32 AM I live in milwaukee wisc. my b/f is sceduled for release in three weeks,
when i moved in this apt i spoke to the manager about my b/f moving in,when released from prison, and explained he has a felony dui, i asked her about him moving here and was told it should not be a problem, she said to let them know, or don't say anything, well i was contacted by the po. as far as his release to be at my address, and got him an application, which was sent along with a letter. i recieved an answer back that he was denied, i was told it was b/c of his criminal record, and that she has to protect the community or people that live here. i explained that he no longer had a licence, she said alot of people don't. but still drive and she can.t take the chance that he will not do it again.
so i guess he is once again covicted of dui , she said after me begging
her to reconcider that she would not but i can appeal her decision. which i have i wrote a letter explain he would not be driving or drinking and will not ever risk his freedom againg after spending the last 3 yrs in prison, i don't think they will let him come here, and wish i would not have said anything. i am soo upset, we have been planning this all this time. it does not seem fair, he has paid for his alcoholism and stupid mistakes, can nobody give them a chance? I
don't know what i am going to do, i am oblicated to the lease now. do i let him here and take the risk of eviction, does he have to have his mom buy him a house to live?? he is also going to be on probation. do they not concider that, if anyone has any advice on anything i can do, please let me know. any places in wisc, wher they would give someone a chance. i am so hurt by this, what does it take to break my leases,or should i just let him move in and risk it?then if evivcted will i be responsible for all the costs???i am confused..thanks Mary

I know I had alot of problems when my guy was due to be released. He adamently refused to go to a halfway house-and I don't blame him. I don't think halfway houses encourage a normal, stable, productive lifesytle. Yet that is what the PO's seem to prefer them to do.
Good luck! Don't give up hope! There has to be a way for you to be together, just keep trying. :o
LUVINMYMEXICAN 08-28-2004, 05:14 AM Angel,
I Understand Your Dilema, Cause I Live In Apts That Do Not Let Anyone With A Prior Felony Conviction To Live Here. My Husband Will Be Released In Four Months, And If We Win His Removal Of His Deportation, Then He Will Be Coming Home To Us. I Either Don't Say Anthing To Mgmt, And Chance Getting Evicted. Or I Try To Find A New Home For The 4 Kids, Me, And The Darn Cat-lol, So He Can Be With Us. My Problem Is These Are Rent Controlled, Because Of My Medical Disabilities. Anywhere Else, And I Jump About $400 More A Month For The Same Type Of Place. I Can't Afford To Do That With 4 Kids, But At The Same Time We All Need To Be With Daddy Again.
As Far As Breaking Your Lease, You Are Probably Responsible For The Last Month Of Rent, After Giving Notice. Sometimes They Try To Stick U With The Amount Of Rent Till The End Of Your Lease, But They Can't Do This If Someone Moves Into The Unit Before Then. It Usually Will Just Give U A Bad Mark On Your Rental Record That U Broke A Lease. To Be Evicted Could Cost U In Court, And Legal Fees. So I Would Say If It Came Down To It, The Best Is To Break The Lease, Rather Than Get Evicted. Best Of Luck To U Girl.
mlk2001 08-28-2004, 05:25 AM usually in your lease there is something called a reletting fee. which lets you out of your contract. its usually 80% of you rent for one month plus you would loose your deposit i would not break your lease or take a chance on getting evicted. that could hurt you worse in the long run. you will end up not being able to get an apartment with that on your record. on the other hand if you only have a few months left there i would stay. look for a house or something that rents by the owner. thats what i have right now and my landlord doesnt do background checks. just a some thaughts. good luck to you.
Keltria 08-28-2004, 06:16 AM In South Africa thats dicrimination and is not allowed. The owner of the apartments can be taken to court. I really feel so sorry for all you people, how do these people ever get to start a new life. No wonder so many of them just end up back in the system. They have no choice.
Retired-10 08-28-2004, 09:01 AM What a situation!
I worked as a leasing agent in college. When someone needed out of their lease we'd allow them to do two things:
- However many months they had left on their lease...say...6 months. And lets say their rent was $500/mo. That'd mean in the next 6 months we'd get $3000 from them. We'd ask that they pay a flat amount to get out of their lease. Maybe $1800 or so.
- The other option was to let them move and we'd just put it up as a vacant apt available to be rented immediately but you'd have to continue paying rent until it was leased again.
When I was working as a leasing agent we didn't care if you had a felony, unless it was a sex offense. I specifically remember a resident of mine having a DUI and it made no difference to us. If residents complain or if you don't pay rent, THEN make it an issue. I think it's ridiculous that they're doing this to you based on the nature of his offense.
Let me know what happens! Good luck!
Ms Lana 08-29-2004, 03:46 AM You might want to look into your rights as a renter too. I can't believe that they can discriminate like that, especially on a DUI. If he can't drive, then they shouldn't be allowed to discriminate saying, he might. That's such a bunch of crap. Does he have to be on the lease to live with you? I know I've had people stay with me that I didn't put on my lease because I didn't want them to be and there were no problems. I wish you the best with this, hopefully your letters will work.

I am so sorrry. For some reason this seems illegal....call the housing authority in your city to check. I would think it would be discrimination.
