Well my husband was denied for parole back in March of 2004 and I was at hearing and he just had some new cases added to his time and the parole board used that as an excuse and told me he would come up for parole again in October 04...he hasnt got any letter about a date so I emailed Cynthia Dillard and she replied today...she said that they are not running behind on non violent cases but since he recently received 2 ..15 year sentences I doubt that he will have a hearing date this year....I emailed her back and told her that his cases were already settled the last time he went up for parole and they knew about that then because thats why they denied him....she emailed me back and said he probably will not get a date this year because the board set new guidelines in April...she said she didnt know how much time he had served but he will be set after he serves 2 years. Ok he has been in prison for 2 years so do you think she means 2 years on the last charges or all the charges put together? Looks like they would do what they said they would do and give him a date in October! Does anyone know what she is talking about new guidelines in April??? I was hoping for a date in October...I am struggling so hard to make it alone and take care of my 2 kids and keep the bills paid and also he was so looking forward to having that date then so that will be a big letdown for him also...I was praying he would be home for the holidays but it doesnt look good!!! thanks you all for listening!! haven't found out anything yet....but it could be the new guildelines for non-violent offenders and the second parole board is the only thing that comes to mind....but i'm still checking...DJ

Thanks Denise but it must be something about how much time they have to serve on a sentence or something because she said he would have to do 2 years before he got a parole date so I am just guessing....hopefully she is wrong or something but I doubt it! Thanks Lisa!

Hey Lisa long time no talk. how's it going. I can answer your question. My husband was reviewed and told he would get a new date at the end of april . at least thats what they said when i called about his date. well it never came so i called and spoke to 50 people i think, finally i got an email from cynthia too she is quick and too the point huh. she said that he missed the hearing date being set by a week that they had set new guidlines about the resets and that he wont get another hearing but hey his eos is oct anyway so i am just looking ahead to that. sorry your having a hard time i feel ya. but yes they did change alot of things and thos on the non violent list that had been up once weren't being reset as soon as they were originally told. take care i'll be in touch Lisa

Hey thanks Ms NU....I am still on here reading all the posts just not getting to write alot here lately....thats good that your husband EOS's in october...bet you are very happy!!! Yes cynthis is quick to the point which I appreciate...alot of them just give you the run around....i'm just wondering what the new guideline is? Would help to know huh! Especially with my bill situation it sure would be nice to have some help around here! Ha! Its rough alone with 2 kids...alot of people just dont realize that...well we will make it though as long as people wait a little longer on thier money! ha! (Never got the date so i re wrote and got this reply.)At this point the Board has not made a decision whether to hear his case again.( 2 weeks later i got this repy ,i hadn't written back in between)
According to changes effective April 29, 2004, to the Special Docket Guidelines:



#3. If parole has previously been considered on Special Docket and denied then the new set date will be as ordered by the hearing panel at the opm (open-public meeting).
(When he had his first hearing it was denied without reset cause they said he only had 8 months left) n e way i can't believe it cause i am sure they saw that before all the above emails. so my hopes went up,down up down)

Ms. NU< seems to me like they are saying that the date they said at the last parole hearing will be the date that they go by right??? At my husbands last parole hearing which was denied they told me he would come up again in October 04 so I dont quite understand why she said that about him not getting a date this year due to changes in guidelines in april....I dont quite understand why they said your husband would come up in April and then change it again....looks like they would have to do what they say they are gonna do....I am waiting for the parole website to change to the October dates then I will know for sure if he will get his date in October but looks like he would be getting a letter since it is going into September huh! Sometimes I think they dont know what they are doing because they brought him up in Dec 29 03 and then again 3 months later on March 29 04 and then said October 04 so it sure is a dang rollercoaster!
