This is total frustration, which I'm sure everyone knows. I'm just learning. This is what happened and I don't understand. My husband is in county jail....within the past two days he now has a # which if I understand is for DOC...and has Arkansad DOC as the facility. But, yesterday morning early they came and picked up a whole group of guys to take to prison. But they didn't take my husband. Can anyone explain why they wouldn't have taken him? He was also told about an Emergency something act for overcrowding. But doesn't he have to go to diagnostics first before he can do that? Help me please. I hate to be such a baby about this. But once I understand the process I will deal with this better. Thanks for all the help so far.

Mine is in Potter County Texas county jail and from what I am told that he has to wait for a chain. and that in texas (i know you are in arkansa) it takes 2 weeks to 38 days from his final court date to catch it. hope this helped

My boyfriend is in pulaski county in arkansas he is waiting to go too. They said he could be there for up to 2 or 3 months before they take him to ADC. I've called and his name isn't on their waiting list yet. I know that the prisons are overcrowded so when beds empty they take the ones from county that have been there longer. How long has he been in county?

rose107 - The "Emergency Powers Act" is what they do when the county jail population goes over 500. They give early parole to non-violent inmates that meet the criteria. After they move those out then they send the ones from the county jail that are waiting to go to prison. My fiancee spent 3 weeks at county and that was a short time compared to some. The ADC website has a very good family guidelines book. It is listed under the constientuency officer. Hope this helped some. I have been where you are. It is very hard when you first start out. After a while it becomes a routine but you never do get used to it.

Thank you for writing. Nothing yet. He is still at county waiting. I did do something. I emailed the Gov. Someone actually called me back and gave me alot of information. Like how much time he was facing and when his first parole date would be. She was very very nice and informative. But still, if they haven't taken him, he is not getting credit for this time so it just adds more time to his time already. I feel so bad for everyone that is going through this experience. We on the outside have our own problems to deal with and yet, speaking for myself, I spend more time worrying about him, and when, and what, and how he is going to survive prison, and if it's going to change him, and what about when he gets out, what will it be like then? We will have lived two different lives, will we adjust to each other again? Enough, I could go on and on, and sometimes do. To much thinking. Il'm just praying that he gets out of county and gets this thing over with. Soon. Thank you so much for checking on me. I feel at times I'm going crazy. Thanks again.

Now my husband has been sent to diagnostic unit. What can he/I expect there? His PE/TE date is 1-5-05. Does that mean he cannot be released under the Emergency Powers Act? And does he have to be paroled to Arkansas? What if he has family and job in another state? The crime was committed in Arkansas but that's not where he is from.

Hope i can help. His PE/TE date is 1/5/05 - what will happen is about 3 months before that he will meet with the parole board. IF they grant him parole, then he will be released on that date OR when the EPA kicks in. The EPA releases everyone who has been granted parole and has a pe/te date within the next three months. (I'm not sure, but i think the epa will kick in in December this time.)

He WILL get credit for his time in county, and will get also get good time for his time in county.

He can parole to another state, you or he will have to talk to the IPO (institutional parole officer) to get the specifics on that.

Try to stay calm. I know right now you just want to do everything you can do, and it's hard to "just wait." Send me a private message if u want.
