COURT CONFIRMS THAT PROP 66 WILL RESTORE VOTER INTENT -- AND CONCLUDES THAT WAS INTENT OF SPONSORS OF THREE STRIRKES LAW TEN YEARS AGO AND REQUIRES OPPONENTS TO REMOVE FALSE AND MISLEADING STATEMENTS.
Sacramento Superior Court Judge Raymond Cadei ordered opponents of Proposition 66, to change their proposed ballot argument today, calling statements in their argument, and their rebuttal to Pro-66 arguments “patently false.” Signers of the patently false statements include Gov. Schwarzenegger and Attorney General Lockyer.
The judge singled out the false claim by opponents that Proposition 66 would release “26,000 convicted criminals” as “patently false” and “mathematically impossible” and ordered the reference stricken or changed. He noted that the claim that the district attorneys association estimate of 26,000 is at best “gross speculation,” and “at worst it’s a mischaracterization of the law (Proposition 66).”
Judge Cadei also ordered references to the potential sentence of accused criminal Charles Rothenberg stricken from the argument, since Rothenberg has not yet been tried or convicted, and he criticized opponents for potentially polluting the state’s entire pool of jurors. “To have an official government publication commenting on the sentence of a criminal defendant before his right to a trial by jury is not appropriate in any event,” he said.
In another victory for Proposition 66 supporters, the judge rejected opponents efforts to stop supporters from saying that Proposition 66 restoring the voters’ intent in assign California’s three strikes law.
I consider this a great victory, Citizens Against Violent Crime worked very hard to ensure our argument was very tight. The judge ruled we need to make one small change, but nothing significant.
