I hope I'm putting this in the right forum. I will also post in Legal.

I have seen where attorneys are able to send legal documents to inmates, correct?

What about inmates requesting legal documents be sent to them directly in prison?

My guy is telling me that he cannot request or receive legal documents, pretty much of anything. Is that correct? He doesn't have a pro bono attorney still on the case because sentencing is complete. Or does he? Can he can access that same attorney or can he access another pro bono attorney, court-appointed or other?

As far as I know, here in Michigan, when legal information is sent by an attorney and is marked as legal mail the inmate gets it. And as far as I know, he can correspond with as many attorneys as he wants to.. I don't believe there is a limit on how many attorneys an inmate can deal with.

I hope this answers your questsions. You may want to consult an attorney on this and get the proper legal answers.

What about him requesting and receiving information directly from the source? One specific item is Proof of Incarceration from past incarcerations.

My husband is in the federal system. Any information they request from courts or clerks or anything he gets. He requests they stamp it or write "legal mail" on it that way they can't read it, only inspect it. It must have a return address from a court or attorney.

His court appointed attorney also handled his appeal and any motions he wanted to submit. I don't know if he had to or just felt guilty for costing my husband his life at 18!!! Check with the attorney to see.

Access to courts and attornies is a constitutional right. I suggest he get in touch with the inmate law library clerk and file a grievance or lawsuit.

Anyone can send legal documents into the prison, but if its not legal mail, it is/or can be read, while if its from an attorney, or law firm, the inmate signs for it, and the mailroom cannot read it.

I have sent legal mail to my guy and at first he had to file a grievance because they didn't give it to him...he gets it all just fine now.

(Inmates cannot receive any legal mail with another inmate's name on it, unless I think, there is paperwork from MDOC designating them as their legal assistant.)

I have sent legal papers to my guy and he has sent tham back to me so far there hasn't been an issue however on this last round I sent for his siggy I haven't rec'd it back yet and it has been over a week and a half since he sent them back which has me a little concerned because his mail usually gets to me in 3 days tops

I don't think it's problem I've sent a lot of legal mail to my guy and he's sent it to me.

I found out in the meantime that prisoners cannot access the FOIA. Is that true?

You are allowed to send an inmate legal documents. I do it for Dre all the time.

I bring legal paperwork into the visit to assure they don't read it... You can do this and they are not allowed to read it, BUT you have to bring it back out with you. You can also have it sent in, but for us it had to come directly from our attorney or they could read it....

How do you go about that? What do they consider legal documents?



I bring legal paperwork into the visit to assure they don't read it... You can do this and they are not allowed to read it, BUT you have to bring it back out with you. You can also have it sent in, but for us it had to come directly from our attorney or they could read it....

I've carried in anything that came from our attorney... I just tell them at the check in desk that I'm sarrying in legal paperwork. Some guards have gone to take it from me and carry it in and I refuse as they are allowed to count the pages but not read it or carry it in.... Most guards have understood and not questioned....

I sent my Hubbie his entire court proceedings in the mail just three days ago (Transcripts) and he received them the very next day unopened. But first I called the prison and asked if he was allowed to have them being that it was coming from me. It was 214 pages in all. They told me yeah, he can have them and to write in big bold letters, Legal Documents. I'd call and check with the mailroom people first. Transcripts are a lot of paper........

If you're not married but you have POA, can you carry them in that way? I checked with the front desk about carrying papers back and they told me that only immediate relatives can carry them and that they must be at least 18. If he has anything to sign, can they be taken back for signature?
