MONTGOMERY, Ala. A federal appeals court today refused
to block the execution of James Barney Hubbard. The
state's oldest death row inmate is scheduled to die by
lethal injection tomorrow (Thursday) night.
The 74-year-old convicted double-murderer asked the
11th U-S Circuit Court of Appeals to block his
execution, arguing he is too old and sick to be put to
death.

Hubbard contends that because of his advanced age and
mental incompetence, his execution would be a form of
cruel and unusual punishment.

He was recently diagnosed with dementia by a
psychologist and claims that he is suffers from
several other health-related ailments.

Hubbard was sentenced to die for the 1977 killing of
62-year-old Lillian Montgomery, a Tuscaloosa woman who
befriended him after he served a prison sentence for
another killing, also in Tuscaloosa County in 1957.

(Stations: Execution scheduled for 6 p-m at Holman
Prison near Atmore.)

I am sorry you may not agree with me but I am under the impression that he is guiylty of his crimes so my question is were his victims allowed to die a natural death I know he may be old and ill but think about the 62 yr. old woman who proabaly had many beatufull yrs ahead of her she lost the right to die a natural death and I feel that his punishment fits his crime noone has the right to take another ones life while we may not always agree with the law and the death penalty he murdered twice what if it was your mother or your sister he had killed I am sorry o upset or anger anyone its just my opnion

Candycane you have every right to your opinion, but for your information it was my child that was murdered and the DP is nothing but revenge.
Killing this man does nothing and will not bring back his victim. Which by the way he says he is innocent of the murder he is being executed for. In fact one of the womens sons has forgiven him and has said that he wished the rest of his family would. because spending all those years hating someone is alot of anger and hate to carry around, it makes you a very bitter person.

Besides all that there is the fact of how many 1000's of dollars we have spent to keep this man on DR, when for about half the cost he could have spent LWOP.

You are right when you say no one has the right to take another life. NOT even the State has that right.

By the way everyone is entitled to their opinion and all though I may not agree with you, I will defend your right to have it.

I agree softheart the DP is nothing but revenge and it also does not bring the victim back or make ANYTHING better - it does not achieve anything except perpetuate murder, which the State has NO right to do . It is wrong and to teach our children that things like murder are WRONG, but under certain circumstances it's ok..........!! I don't know hey, what's wrong is wrong. It's black and white with no gray areas. Murder is wrong.

While my point was never to enter into a full blown debate about this I was simply stating my opnion I probably should respond to this but being the stubborn person I am I will LOL

I am truly sorry for your loss and I am sorry you and your child had to fall victim to such a tragic thing however I was and am under the impression he is guilty I feel like God wants us to follow mans law and at the current time mans law happens to be the DP while everyone has there opnion and dully noted not always will opnions match I respect you for allowing and not being angry with me for mine as I am not angry and and respect you for your I still feel that if he did cut someones life short the proper puishment be he or she pay there debt to society with there lives as well obviously somewhere someone felt he was still a danger to others such as inamtes guards thats why he was sentenced to the DP and I just feel like it should be carried out and I pray that he has made his piece with God and and finds himself living a healty life with his victims and they can all live with eternal life unscared by what took place here on earth. God Bless and thanks again for being so respectfull and kind once again I am sorry for your loss
