View Full Version : how much time served on class c 2nd degree forgery

my huband was sentenced july 26, 2004 to 3 1/2 years for a class c 2nd degree felony. how much time will he have to serve? how does early release work? he goes to diagnostic unit in pine bluff first i guess. how long will he stay there? will he be sent somewhere else to serve his sentence? sorry so many questons. this is all new to us.

I am going to try and answer this as best as I can. I am not for sure but that is how I understand it.

He will go to diagnostic for about 3 weeks or so. Then he will be sent to a prison that can best use the skills that he has and wherever there is an opening. I have heard that a lot of guys get sent to Varner and Cummins.

If he behaves and gets the maximun amount of good time, I believe he should serve 1/4 of his time and maybe even get out a little sooner. That is if it isn't on the 70% rule.

what is the 70% rule? also, i read that the time could be 1/6, could that be true? thank you for your help.

Some class "Y" felonies like murder, rape, manufacturing meth...., they would have to serve atleast 70% of their time before they would be eligible for parole. I personally have not heard of serving 1/6 of their sentence, but that doesn't mean it is not true. I am only going by my research I have done on my fiance's charge.

When my fiancee went in, he spent almost a month and a half at diagnostics. From there they transferred him to Cummins. At Cummins he at to do 60 days and then he recieved time off his sentence for good behavior. He is set to serve a 1/6 of his sentence IF he makes parole. His sentence is 15 years. His TE/PE date was Feb 2007, after his good time it is now Oct 2006.
When he gets his id number, you can go to the ADC website and look up his record. It will tell you how long and when his first chance at parole is.
I hope this was some help. I know how confusing this stuff is. I was scared to death. Also the constituent officer is very helpful with questions. There is a family guidelines book on the ADC website too. It was a lot of help to me. The PTO has been the place that I have recieved my best help though.

What is a constituent officer? This is all so confusing. And the bottom line is how long before he comes home. But that is the most difficult answer to get. He is at the Bentonville Jail right now and I understand it could be months before the prison comes to get him. Isn't there someone to write and beg to come get him so he can get his time over and come home? I have to stop and think a minute, that it could be so much worse. But in the same breath, is this the answer to non violent crimes? This was the one and only crime my husband has committed and it happened over six years ago. Just doesn' make sense to waste lives like this. You have been very kind to reply to my questions. Thank you.
