Hello All! My name is Karen and my boyfriend is in the Federal Prison. He was sentenced to 36 months and I am so CONFUSED!!!
He has been moved around so many times it is not funny and then they sent him to a Boot Camp and because he tore his ligaments in his knee, he was medically discharged. So now he has to go back in the system but now they are sending him to Arkansas. Could someone please tell me if he would be eligible to file for a clemency and if so, would he do it through Arkansas since he is on his way there or would it have to be from the state that sentenced him (TN).
I appreciate all the help I can get.

Karen, if he files for clemency he would not file in a particular state. He would file a federal petition. Most law libraries in the fed system have copies of this petition.

To be honest, clemency is very difficult to get and he would probably serve his time before his petition could be addressed.

I am sorry to hear about boot camp and the fact that he was moved so much. I understand as I was moved 3 times in 4 years.

I have to agree with cjjack (she forces me, :p ) on the clemency issue.

But...we are at a time where many other things that could change the amount of time our loved ones serve are starting to happen! Check out the "sticky" posts, including the Federal Parole bill legislation in the main fed forum here.

the feds move 'em at the drop of a hat it seems..my son has moved 12 times since november 2003...and still has no permanent location
