View Full Version : Parole in New york State - help
I'm new on this board, actually new to this whole situation really. My fiance was convisted of Aggravated Criminal COntempt D-non-violwnt felony. He went in to county jail, in an Upstate-NY facility in June 2002, and was sentenced in Nov., now he has been moved twice, right now, he is in Bare hill, up near Canada..In any case, this has been an absolute nightmare..His crime was not not typical situation, he assaulted his slalker, who had been ruining every aspect of his life for months. He pretty much had a nervous breakdown. He did commit a crime, I never deny that, and he should be punished I suppose. I fought as hard as I could in DA's offices, and with lawyers. It was a tough case, and I blame local authorites for not dealing with the situation before it got so far out of hand that he reacted violently. Anyway, his charge was reduced quite a bit...he could have been up more much more, attempted murder, if his stalker had their way, but most involved with the decision knew the circumstances. I have been told by lawyers, and officials that he would most likely be paroled in June 2002, which is his ER date. They comfoted me with this little bit, and I have been believing right along...I post on another group, and one woman from NY told me that it's almost impossible to get out on ER in NY, rarely happens...Not to get my hopes up. Does anyone know if this is true?? I want him to be a model prisoner no matter what, but I also don't want him to be blindsided by a negative decision...I want to write letters, personally I would like to hire lawyers...but I don't want to piss local authorites off...He has some serious medical problems, not to mention mental after this ordeal...What are our chances? What should I be doing now?? Should I prepare him, tell him that its more likely hw won't get early release?
Thanks for any info...If I could help anyone I would, but I'm so new at this, and it seems I am encountering all worst case scenerios at every turn....

luna, i don't have any practical advice to offer you, but i would like to offer my emotional support and let you know that we are here for you. i'm so sorry you have to live through this nightmare. i'm sure others can offer you more practical information.

I appreciate your kind offering. I'm sure there are more people in the dark than out of it when it comes to dealing with DOCS...I think maybe I will post this in the NY section to, that might help....

Gilly 12-17-2002, 12:19 PM Hi Luna. I hate to agree but it is extremely unlikely he will make his first Board with Pataki as Governor. My man was just denied parole and he is a model prisoner. (He is serving 1-3 for a non-violent D felony in NY.) I have yet to hear ANYONE say they made their first parole when they're not being deported. It's best to be prepared for the worst and be surprised if it's otherwise. I wish I could tell you different, Luna, I really do. Good luck.

Does anyone have any advice for me? My husband will be transferred from New York to Pennsylvania. AND THAT PROCESS HAS BEEN A NIGHTMARE!!! NO ONE wants to do their job and move his paperwork along, so I want to take action, even if I have to go to the ACLU. I am willing to listen to any and all advice. This is a difficult task, advocating for loved ones behind bars, but if we won't, who will? P.S. I just found out that I passed all my tests to get my Masters in Journalism and I want to tell the whole world!!! Stay strong everyone. I'm glad to be back.:D :D :D P.S. PATAKI BLOWS!!!!! He is selfish and cruel to prisoners and gives them no rights. Luna, my husband went before the board 3 times and was denied...don't want to discourage you, just be prepared for all the crap. Jail in NY is easy to get into, hard to get out...
KREEMIE 01-21-2003, 08:33 AM WELL I GUESS IM THE LUCKY ONE THEN HUH. GLENN WENT TO THE BOARD AND IS GETTING RELEASED ON A CR DATE WHICH IS FEBRUARY 21ST. SO YES IT IS POSSIBLE I GUESS. I DONT KNOW WHAT HE DID TO MAKE THIS HAPPEN BUT SOMETIMES ITS JUST PLAIN LUCK. HE ALSO SERVED A 1-3 YEAR BID AND THE FIRST CHANCE HE GOT HE'S OUT. CROSS YOUR FINGERS AND PRAY REAL HARD BECAUSE N.Y. STATE PAROLE STINKS LIKE S---. GOOD LUCK.
Gilly 01-21-2003, 08:42 AM Unless they have done something to lose their "good time" they will almost always be released on their CR date. At least in the State of NY, that is. I don't know what the policy is for the other states.
Well, I ahve done a lot of research since I posted this, and I've learned a few things. I've heard from others who's loved one's made parole the first time around, and some who haven't..I hear a lot about Programs being the ticket out, and about preparing a parole package..The way I see it, me and my loved one will do all that we can do make it. If it doesn't work, it's because of something beyond our control..and we'll deal with it I guess...what else can you do? His first appearnece is in April..I will be sure to post results then...

Mrs. Twan 01-21-2003, 09:35 PM Yeah most guys get out on their CR date, my husband will be out on March 24th, but there might be delays because of the interstate paperwork. Which sucks. Its not impossible.
