View Full Version : Does anyone have any information about Truth in Sentencing Laws?

Ok. I just spoke with my fiance less than 15 minutes ago, and what he's saying is the counselors were passing out release packets today. Word is it's something to do with the 65% instead of 85%. Non dangerous something or another. Someones family called central office in Arizona today, and they said yes this is true and will go into effect as of November.
Does anyone know something that I don't? He's gonna try to get more info. Has anyone heard anything? If so let me know PLEASE......

UPDATE: I called Central Office today, she said the packets they are handing out is for SB1291, (?) the 3 months early for drug offenders. So unfortunately the wrong information is spreading thru the prison and alot of our guys got there hopes up, along with myself, so anyways that's what I found out.

Is the three months early for drug inmates on top of Earned Release Credits? I'm curious about this.

Girl, I have no idea. All she said is that the release packet goes out 6 months before their release date. Sorry, I wish I knew.

Ok seriously someones gotta help me out, I'm loosin my mind. UPDATE, I just talked to Mikey and his next door neighbor, he got a release packet, he's going home, he's not supposed to get out until 2009, what's going on? He said it's something to do with non violen drug offenders Ch 13:34 something or another. He's only been down a year! Please................. anyone, what is going on?

they did pass a drug offender bill last session ... but it was for those who did the program I thought .. check the az legislative pages

does anyone have the number for the central office
on a seperate note ??

I have it figured out, this is good news for alot of drug offenders, depending upon the charges, what it it is the revised Arizona Statues, look on Alis Online under Statues and you will see the final whatever it is on everything. It's really hard to understand, but i do know that inmates are benefiting from it. Gotta go right now, I'm expecting a phone call, I'll give more info later! Mel

Basically, I went to ALIS Online and looked at the Arizona Revised Statutes, this is really confusing because I don't understand any of it. Chapter 13 is Criminal Code, All I know is that there are a few guys that got release packets that haven't been down that long and that weren't expected to be released for several more years. I'm gonna have to call Arizona tommorow and see how this is going to effect Mikey, or if it will. Sb1291 and HB2646 involve drug offenders being released 3 month early and also 180 days earlier, but as far as the other, I just can't figure it out. I'm going crazy here!!!!! One of the guys will be talking to a counselor tommorow so he will find out exactly what is going on. I wish I could tell you more, but I don't understand any of this myself. I'll keep you updated when I find out more info.

The General Information # for Central Office is 602-542-5536 and the Time Computation Unit # is 602-542-5586.
Please let us all know what you find out and whether they are doing this at random prisons or how exactly it is or will be working.

Ok everyone, I got the low down. I called Time Computation Office and what they are doing is for anyone whose ruling sentence is drug related is eligible to participate. The inmate has to agree to participate in an in-house drug treatment program and once released they have to participate in an outpatient drug treatment program at their own expense. This bill for 'kicking them out' three months early IS on top of their Earned Release Credits. The have to apply with the packet and they can talk to their CO III that is assigned to them. There are a few things that disqualify them i.e. sex offender, murder etc. If anyone has any other questions, they should call the Time Computation Office 602-542-5586 and speak to Nancy. She is a supervisor and is very pleasant. Good luck to all. See the things we can learn when we all put our heads together!!!

i hope this helps my baby out. Because he is not due to come home until 2009. But a guard had told him that because of over crowding in arizona. They were considering going from 85% -65%. So who knows.

What about this "Rule32" that I heard about ?? on aggrivated sentences ? I guess in Blakely vs. Washington(2004) it was ruled a judge can not add time to a sentence or something like that ??? anyone heard about this ???
I'm doing as much research as possible but can't do as much as needed on the library computer with a 1 hour a day limit :)

I haven't heard anything about that yet. I have a friend who has been on the Mountain View Unit since 1980 on a 60 year sentence and she's under the 1/3 old law. It's been 26 years now and she's still there. I was on the same unit under the same 1/3 law doing a 25 year sentence from 1986-1990. So, what's really going on with the system... I'm trying to find out why is she still there.....:mad:

Wow MOMMYT22....I'm not sure I don't have the answer to that! To my previous thread, yes the inmates will be elegible for 90 day early release, but those packets were not to be issued as of now and that was an oversight on ADC part.

rule 32 is where the sentencing judge can be asked to review the case as there were discrepancies in the sentencing.. that is a simple version..
the blakely case was not retroactive and only applies to cases pending or on appeal.. and since no guidelines were set out... it is a shake of the dice to see if you would get a reduction as it can work the other way as well and the judge will sentence the person to more time..
bottom line AZ seems to like the corrections business as it does make money tho they have lots of headaches from it.. they have nothing in the works to allow our loved ones out early.... there is the drug programs to give the three months but that is it..
we all have to keep the faith and stay strong for our loved ones..
a rule 32 is different from the blakely/washington decision tho..
